Promoters Battle It Out Over Don Hill Tribute

Beloved club owner Don Hill -- who died last year -- got a big rock-band tribute at Irving Plaza recently, orchestrated by nightlife hero Trigger with the help of promoters Lyle Derek and Michael Schmidt (who did the long-running Squeezebox bash at Don Hill's).

But true to his name, Trigger is pissed.

He feels he spent money to throw the event, only to have Derek and Schmidt do their own pre-event two nights earlier, taking the wind out of the big night.


According to Trigger:

"What Michael Schmidt and Lyle Derek just did to me has me feeling violated. You all know that I booked this event for our celebration of our dear, deceased, friend Don Hill.

"When Squeezebox came aboard we were all ecstatic! It was going to be expensive for me because Irving Plaza was adding on 3 grand to the original rent because Michael needed the room from 1-4 am and the original 8 grand rental was only till 1am. Michael also asked me for an additional 3 grand guarantee to pay for Jayne County, Patrick Briggs, and himself to be able to fly in and to also pay some performers.

"I felt that i'd maybe come close to breaking even with what Michael was calling the Final Squeezebox. Little did i know that Michael was hosting a 'Pre Party' to my event two days before at DropOut with Miss Guy spinning and Jayne County performing. I wasn't aware of this till two days before Dropout when Lyle emailed me about it saying 'I hope you don't mind that I'm having Jayne County perform one or two of her non hits and no one's going to know about it' as if I had a choice.

"This was two days before his event and 4 days before mine. I brought this up to Michael and he said 'That won't hurt your event at all. We're all promoting your event Thursday night! I'm even making an appearance at Dropout to promote your event.'...

"Calling it a 'Pre Party' was just a sham. Dropout was THE PARTY!!! They used my money, my Voice ad (Lyle had the nerve to ask me to say that we were screening his Squeezebox Film all night at my Irving Show). I stupidly agreed to it cause it was all for the cause in my naive mind.

"In reality I spent 3 grand to fly these guys in to do DropOut where there's no cover charge and it was wall to wall jammed with all of the same people that would have come to our event had there not been basically the same event two nights earlier, without all of the rock bands taking up 2/3's of the night and Dropout was FREE!!!

"Lyle said it was going to be a surprise and not promoted at all but we all know how the internet works and word got out as they knew it would and their event was jam packed and Squeezebox drew just 46 paid people to my event at Irving Plaza!!!!!!!!!! Lyle even told me he'd email me an invite but he never did cause had i been there and basically seen my night completely submarined financially, spiritually and emotionally I would have flipped out. He never did email me an invite. Smart man.

"These guys sandbagged me and had the nerve to hug me and thank me the night of my event for what I was doing for Don and the Scene while they had already surreptitiously stabbed me in the back.

"I will recover from this at some point. I will never regain the 11 thousand dollars i lost on this but I did a beautiful thing for a beautiful man and i will take my losses like a mensch and move forward. While it's true that i'm doing better just running my place as a local bar rather than a punk rock club, 11 thousand dollars is an awful lot of money to me as it is to most of us.

"But will these two creeps ever recover from the bad Karma they've created for themselves here in manipulating me, double dipping and overall, fucking me over??? I did something pure, from my heart and backed it up with my wallet. Even though i knew i was taking a bath i paid everyone what i was supposed to. Even those two losers.

"It is regretful that the 'Celebration of Don Hill' was not more successful (financially speaking for Trigger). I have nothing but respect for my elders and peers in nightlife, especially Don who the night was really about and the man that helped start Dropout and gave us the chance to do something fun in NY and bring worlds together.

Trigger everyone in town still thinks you are the blame after your boring long winded responses. This is the most press or action you have gotten your whole career and its a joke! So you have NO LIFE and want to keep thin up...THEN.... There are stories coming out against you soon that are going rock this town and throw you out!. Oops. My post was actually included yesterday morning. And yet some have read it and still defend Lyle!This is proof that some people simply cannot be objective. btw- if u read Schmidts list of rules for Lyle to follow no where does he say anything like "and I must clear this with Trigger"I honestly think he thought I'd never hear about it cause as I've said- Lyle brought this up not Michael. My intuition tells me that Lyle would have cleared Tweeting, Facebook and the hundreds of texts that went out. A- u don't bite the hand that feeds u. B- they're great friends and doing this behind Schmidts back doesn't make sense. Bottom Line- their show never should have taken place. I already had an uphill battle as Schmidt pointed out. Why make it worse for me by doing it for free at a better time slot two nights earlier? But it did happen so why wasn't the "no mentioning of Jayne condition" honored. There's a huge inconsistency here. EitherSchmidt never even said that, or changed his mind if Lyle asked him if they could Tweet and FB zillions of people or Lyle did this against Michaels instructions which I sincerely doubt. Am I missing something or is Michael Schmidts response missing from this Blog?

I've written something Sunday but perhaps it was too large for this blog. I'm working on having it added. I'm curious to hear what my critics have to say after reading it and seeing proof of what I've been saying all along happened here. Some people are so negatively predisposed nothing can get thru to them. So be it. Again- I did something selfless for a great man and some people had their own agendas. Whats so shocking to me is that Don gave these people their careers in nightlife and apparently his character and integrity didn't rub off on them cause they undermined the one single event intended to honor him. You'll see what I'm talking about soon.

I am also glad that Michael Schmidt has responded to my issues with he and Lyle Derek.My response to Michael-"threats of harm" someone please point out any threats I've made. Yes, I was furious and have since apologized here and also directly to both of these gentlemen directly. My language was rough indeed. I apologized for this but my position re being screwed over by them is fully in tact and even stronger than before. Read on and you'll see why.I did not "allow him to have the door" I fronted 3 grand to Irving for the rent and guaranteed another 3 grand that MIchael had asked for talent and flights.I was to get any income from the door towards recovering the 6 grand i was laying out.I promised you the room between 12:30 and 1am at the latest. we finished before 1.THIS IS MY FAVORITE- MICHAEL'S 2ND CONDITION TO LYLE'S BOOKING JAYNE COUNTY TWO NIGHTS BEFORE MY SHOW- "Two, he could not announce her as a performer. She could be billed as a Special Surprise Guest and the night had to be billed as a Pre-Party for the upcoming SqueezeBox event at Irving Plaza"*READ JUST A FEW OF THE LISTINGS I FOUIND ON LINE THAT WENT OUT THE DAY OF DROPOUT. TWO DAYS BEFORE MY SHOW!Yes- all of Michaels concerns were valid and i knew intuitively that i'd never take in the 6 grand i had invested in the night to honor Don but I had made other such moves for this night like flying Frankie Inglese in to DJ cause Beavher and Soul Kitchen were also such a huge part of Don Hills. There was no palpable return on that financially but it was my intention to make this a night to honor Don in every possible way.So Michael being a very, very smart man, knowing the event wasn't selling well, why would he hold, virtually the same thing, two nights before, at a current hot weekly night, with an earlier time slot and with NO COVER CHARGE if he was aware of my inherent challenges to begin with??? He never brought this up to me and certainly didn't say he was "Hosting" when I brought it up to him after ZLyle emailed me about this!Why?- his motivation wasn't money or greed. I'm sure of that. I don't know him very well but others I respect have told me this and i sense that their absolutely correct. It was because of Squeezebox and Old School Loyalty to Derek! that's why. Derek asked him and maybe he believed and trusted that they wouldn't mention Jayne or promote it that way. The old SB crowd is a great crowd indeed and they do look out for each other. as far as my learning of this- I think even Lyle would admit that his mention via email to me of Jayne performing was the very first i had ever heard of this cause I sent him back a very sarcastic email. he emailed me and asked if he could call me. He sounded genuinely concerned that i was upset upon first learning of their having Jayne County play their FREE EVENT two nights before my, already logistically challenged event. He assured me there would be no mention of her name in any way. (see his tweets down below the day of, when they BLASTED  the heck out of it.Michael did NOT inform me of this or ask if it was ok!!! Lyle did sort of, after the fact. Michael says that i'm blaming the entire night on him-again, I think that Lyle will acknowledge receiving the email from me, that i sent to him and Michael see below*, stating that I "did not blame this whole thing on the two of you but you certainly didn't help things" or something to that effect. my part of the night drew 500 or so. 400'ish of which paid. 100 or so guests. that's not terrible but it was the next 500 tix sales that i really needed to break even and write a check to Don's Church with. It didn't happen. ask anyone involved that night- I emailed everyone of them 7-10 days before the show and said that the show wasn't selling very well and to please do everything they could to promote. We received lots of great, publicity courtesy of our publicist James Sliman, the bands and myself promoted like crazy but perhaps it was too many bands- It was hard to say no to so many people that played Don's or Cat Club back in the day as it was i had several bands on standby. Manitoba quitting 4 days before the show because i wouldn't tell him who i had guarantees out to and how much for (I have this in texts and on voicemail in my phone) didn't help things either. We were friends for a good 20 years though. He came to Continental much more than I went to his club cause i had no partners or managers and rarely took nights off. He was a generation ahead of me of club owners that i looked up to and respected. When he came to my club I went out of my way to reciprocate in the same way that he treated me, like a King. He made everyone feel that way. He was always with Michael H either coming to see Michael play at my club or coming with Michael to see other friends play. I've got my friends and people that i consider family. I've also got plenty of detractors. That comes from, in my humble opinion, my letting people know when they've crossed a boundary they shouldn't and the fact that i did my own door for many years to make ends meet. Everyone in this scene (and most scenes) wants to get in free and drink free!!! Vito Bruno (another club owner from back in the day said that to me in the early 80's!!!) and the more things change the more they stay the same! i let the people in for free that i thought were contributing to my club and our community in general, not just because they were wanna be's, slept with someone important or at one time had a record deal or a buzz of some sort. He made everyone feel that way. He was always with Michael H either coming to see Michael play at my club or coming with Michael to see other friends play. I've got my friends and people that i consider family. I've also got plenty of detractors. That comes from, in my humble opinion, my letting people know when they've crossed a boundary they shouldn't and the fact that i did my own door for many years to make ends meet. Everyone in this scene (and most scenes) wants to get in free and drink free!!! Yes, I was furious and have since apologized here and also directly to both of these gentlemen directly. My language was rough indeed. ps- having a "Surprise Guest" and keeping a secret is supposed to be respected like-When Joey Ramone told me a week before his Annual Christmas Show "Ronnie Spectors going to do a few songs with me and the Uptown Horns but if word gets out she'll cancel cause her BB Kings Christmas Show isn't sold out yet and they'll freak"I never said a word or mentioned this ANYWHERE!!! and Ronnie did it with Joey a few times here at my club.

When Guns n Roses manager, at the height of their Stardom in the early 90's, called me at the club and said "The guys are having dinner now and said they feel like playing in a couple of hours. Got any instruments laying around?" It was perfect cause i had  party a for 20 or so of my best bands that night. He added "don't spread the word cause they don't have their security tonight and if there's paparazzi or a mob outside they'll just keep driving."of course i didn't tell anyone and at midnight 5 limos pulled up and they played for 2 hours and Slash signed everyone's guitar!

I am also glad that MIchael Schmidt has responded- here's MY response to what's true and false in Michaels response-"threats of harm" someone please point out any threats I've made.  My language was rough indeed. I apologized for this but my position re being screwed over by them is fully in tact and even stronger than before. Read on and you'll see why.I did not "allow him to have the door" I fronted 3 grand to Irving for the rent and guaranteed another 3 grand that MIchael had asked for talent and flights. He received this as well, in spite of everything!I was to get any income from the door towards recovering the 6 grand i was laying out.I promised you the room between 12:30 and 1am at the latest. we finished before 1.THIS IS MY FAVORITE- MICHAEL'S 2ND CONDITION TO LYLE'S BOOKING JAYNE COUNTY TWO NIGHTS BEFORE MY SHOW- "Two, he could not announce her as a performer. TWO DAYS BEFORE MY SHOW!Yes- all of Michaels concerns were valid and i knew intuitively that i'd never take in the 6 grand i had invested in the just the Squeezebox portion of our night to honor Don but I had made other such moves for this night like flying Frankie Inglese in to DJ cause Beavher and Soul Kitchen were also such a huge part of Don Hills. There was no palpable return on that financially but it was my intention to make this night to honor Don complete in every possible way.So Michael being a very, very smart man, knowing the event wasn't selling well, why would he hold, virtually the same thing, two nights before, at a current hot weekly night, with an earlier time slot and with NO COVER CHARGE if he was aware of the inherent challenges my Irving show had to begin with??? He never brought this up to me and certainly didn't say he was "Hosting" when I brought it up to him after Lyle emailed me about this!Why?- his motivation wasn't money or greed. I'm sure of that. I don't know him very well but others I respect have told me this and i sense that their absolutely correct. It was more because of Squeezebox and Old School Loyalty to Derek! that's why. Derek asked him and maybe he believed and trusted that they wouldn't mention Jayne or promote it that way. The old SB crowd is a great crowd indeed and they do look out for each other. as far as my learning of this first on 12/10- I think even Lyle would admit that his mention via email to me of Jayne performing was the very first i had ever heard of this cause I sent him back a very sarcastic email. he emailed me and asked if he could call me. He sounded genuinely concerned that i was upset upon first learning of their having Jayne County play their FREE EVENT two nights before my, already logistically challenged event. He assured me there would be no mention of her name in any way. (see his tweets down below the day of, when they BLASTED  the heck out of it.Michael did NOT inform me of this or ask if it was ok!!! Lyle did sort of, after the fact. Michael says that i'm blaming the entire night on him-again, I think that Lyle will acknowledge receiving the email from me, that i sent to him and Michael see below*, stating that I "did not blame this whole thing on the two of you but you certainly didn't help things" or something to that effect. my part of the night drew 500 or so. 400'ish of which paid. 100 or so guests. that's not terrible but it was the next 500 tix sales that i really needed to break even and write a check to Don's Church with. It didn't happen. ask anyone involved that night- I emailed everyone of them 7-10 days before the show and said that the show wasn't selling very well and to please do everything they could to promote. We received lots of great, publicity courtesy of our publicist James Sliman, the bands and myself promoted like crazy but perhaps it was too many bands- It was hard to say no to so many people that played Don's or Cat Club back in the day as it was i had several bands on standby. Manitoba quitting 4 days before the show because i wouldn't tell him who i had guarantees out to and how much for (I have this in texts and on voicemail in my phone) didn't help things either. What a guy!Michael, btw- loved that the bands were getting just two songs each  and even mentioned a couple of more to add on (like Jamie Burkes band, remember Michael-? you weren't telling me to reduce the # of bands- as he's claiming)Homophobic? Oh- i re read my emails and accidentally called Jayne, Wayne. I only made this mistake once  or twice I think out of quite a few times of mentioning Jayne. Give me a break!"Had you come to me as a peer rather than an aggressor..."  i wrote you both a week after the show about my losses, not blaming the entire thing on you but saying that the "Pre Party" certainly  did some damage. didn't hear back from you Michael.Bottom line- in my opinion this was not a malicious act or greed on Michaels part but this was never cleared with me and when it was finally brought up to me by Lyle 3 days before his event I was assured that there would be ABSOLUTELY NO PROMOTION re JAYNE COUNTY'S PERFORMING TWO NIGHTS BEFORE YOUR IRVING PLAZA SHOW.I was foolish and believed them. did Lyle do this behind Michael's back? I don't know. they seem like great friends. I've also got plenty of detractors. Everyone in this scene (and most scenes) wants to get in free and drink free! Vito Bruno (another club owner from back in the day said that to me in the early 80's!) and the more things change the more they stay the same! i let the people in for free that i thought were contributing to my club and our community in general, not just because they were wanna be's, slept with someone important or at one time had a record deal or a buzz of some sort. I guess him being the "NEW MUSTO" as he hopes is over! But Musto got what he wanted and the drama is ON!. This freak wants two inncoent cool people to pay him for his mistake for no reason? This is NYC secret shows and pre paries happen all the time and right on for the Drop Out party folks for trying to make something fun happen in our city that needs this kind of fun again!!! I havent been but I am going now! And If I were Schmidt and Derek I would sue the hell out of this Trigger creep as they have a case beyond a case and my dad is a lawyer and he just read this whole drama and wants to help rep them. These are my final thoughts on this entire matter-I've received some criticism (that's a surprise!) from someone regarding my language in my 2 emails about this matter and how i spoke about Michael S and Lyle. yes- my words were no doubt harsh. but even harsher was the way that I was treated! this person never even spoke on that. What's more important- someone's actions or the words one uses to describe them?What was so surprising to me is that I've always liked both of these guys and deeply respected what they've done in NYC nightlife. Lyle I know a little better cause he managed The Toilet Boys for a while and i ran into Michael in LA a few years ago, backstage at a Blondie show of course and he couldn't have been nicer. While booking and working on this show everyone's love for Don was so abundant it was really lovely to be a part of this and especially to be the point person for this event and I guess I sort of let down my guard down. That was my first mistake.My questions and issues are these-How could Michael be hosting and including Wayne County in his event two nights before mine without either clearing it with me (as I'd committed 6 grand to Squeezebox to have Michael hosting and Wayne performing at my event!!) or at least give me the choice of doing SB in spite of his Dropout event or my not doing SB at all??? because SB and Dropout were virtually the same event and crowd- a crowd for Dropout anyway.That would only be fair right? Michael never even brought it up at all and he had to have been planning that for many weeks with Lyle. it only came up when Lyle, out of guilt I'm sure, brought this up to me a couple of days before Dropout. is this the way these guys do things??? apparently so. it should have been one show or the other- not both! I was never given that choice. NOT RIGHT!!!I was so flawed by this and then seeing that only 46 people attended SB at my Irving show at $10 each it added insult to injury.When the dust and stress finally cleared a week later it sunk in what had really just taken place. I felt used and screwed over. Who wouldn't? Could you imagine if someone had done something like this to them??? They'd be tarred and feathered and ostracized from nightlife forever!!!Again what's so shocking and making me feel so betrayed and violated is that this was supposed to be about our love and appreciation for Don.Wasn't it??? But some people made this about themselves first and Don last, if at all.They should do the right thing and pay me back. A- it wasn't fair for me to throw 6 grand out the window andB- their Karma needs cleansing.if they don't have it all at once they should each send me a couple of hundred every month till i'm paid back. Anyone who knows Michael Schmidt knows that he is honest, honorable, and cares about putting on a good party. And it is common knowledge that Trigger is the most hated nightlife "hero" New York has ever seen, for reasons like this tantrum of an email. The party was poorly put together and in the end, it appears it was all about Trigger's ego and nothing about Don. Shame on you, Michael Musto, for printing this nonsense without asking Michael Schmidt for his side of the story.

More wind-I am the infamous TRIGGER! Yes, I was hoping to personally break even and donate anything after that to Dons Church.If the show sold out or close to it, I would have been able to do that. I put up 25 Grand, tons of time and energy, was quite stressed out for 3 months by the complicated logistics and personalities involved here and my sole motivation was to do right by Don and make him proud. I always looked up to him and whether he knew it or not he was a mentor, by example,  to many of younger club owners.As I have said before, I can accept that the band part of the night didn't draw as well as I expected. Perhaps I should have had just a few headliners? I'm not so sure and I guess we'll never know. Don was so beloved and touched so many, that as it was, I had 8 bands on standby ready to play if anyone cancelled. All of us that were there (around 500) had a wonderful time celebrating the life and impact that this special man had on so many of us.The Squeezebox incident was very hurtful to me financially and personally. I wasn't in business or defense mode or at all questioning peoples motives or agendas as I assumed that we were all on the same page re why we were doing this in the first place. Extremely naive on my part I admit.and there's a lot of crap being said as always. people are addicted to drama and negativity. That's why the Tabloids sell much more than hard news. I did make this public it's true but only because Michael and Derek ignored my email regarding their actions and the resulting financial loss that i took.I never get on Facebook like others to voice displeasure. I've graduated high school and don't make my issues with people global. I  wrote Michael Musto and a few others that know all of the players involved here cause if Michael S and Derek weren't going to be accountable with me than I at least wanted people to watch their backs with them in future dealings. Had Derek and Michael said something to the effect that they were truly sorry and would make it up to me though it might take some time, that would have been fine. I have also suggested to them that the 3 of us seek informal arbitration by someone we all know and can agree on like Steven Lewis or Chi Chi and or Johnny- they ignored this as well.Yes, there are plenty of people that have issues with me and the way I ran my little Rock Club for years and I'm well aware of that. I could care less. I've lasted 20 years for a reason. Inherent in any Rock Scene is going to be loads of dysfunction. It goes with the territory. I just would never allow the inmates to run the Asylum. That's what it always came down to- my being able to say no to people when they crossed certain boundaries. That said, when people that I respect have a criticism or issue with me or something I've done I'm all ears and am always looking to grow and be a better person.Bottom line- I did something pure from my heart and people projected their own egos, agendas and greed on to it. It was a great show. Concerning the low attendance, the buzz I heard was that people didn't want to pay 35 dollars for a ticket what with Christmas/Holidays upon us.(money is tight for many of us) If admission was less, or a different date away from the holidays was set, I think more folks may have attended. Maybe.

It is a big sin for a promoter to expect to cover some of the expenses associated with a show before he turns over the profit to charity? Must be that many who have commented toss money out their car window for fun when they are driving down the highway. Who the HELL can lay out 11k and not get at least partially reimbursed. Not the smartest choice of venue and not a good idea to bank 11K on someone who is a guaranteed draw of 80 people, 50 who beg to be on the guest list. The way the story sounds Trigger was used by Jayne County to get a free trip to support a party of a friend. Someone who has been around the block since cars had square wheels knows that appearing at a free party two days before appearing in a show with expensive tickets is guaranteed to screw up the the show. It seems that this County did not care about Don Hill's memory, or the show. Inactive unknown bands is right. How do you know this is true? A thirty year reputation for screwing up shows, meanness and lying like a rug shows it is a pattern. Trigger would have done better to sell t shirts on ebay.

Trigger has fought with everyone..including in the past some of the headliners mentioned here.My Lipstick Killers headlined the Arthur Kane tribute at Continental years back..we brought in 90 people at 1am and he found a way to start a fight with me..He turned one of the premiere authentic rock clubs into a generic NYU bar to make more money..the Dropout party is very popular and is crowded every week(with or without Squeezebox)..i didn't find out about it until 10pm that night..i paid $25 to wait 6 hours(watching bands I have never heard of) to catch Jayne County,David Johansen and Handsome Dick Manitoba( was advertised but didn't even show!). If you are going to put together a tribute to a dear friend and charge $25 and would like to make a profit put the headliners on before 1am on a weeknight.

The reason the night was probably a failure was that there were too many inactive or unknown bands playing only a couple of songs each with a $25 price tag. If you only wanted to see one of the bands play, would you pay $12.50 per song? I wouldn't.

As for this later event, SqueezeBox, I'd pretty much never even heard of it before this event. It's some party from the 90's and what, people are supposed to pay a cover to get into it?

Many people who would pay a cover charge work Friday mornings so it doesn't make sense to think that reviving a decade-gone party to draw a crowd at 1 AM on a Thursday night with a $10 cover charge. Many people still out at 1 AM want to use that $10 on a drink, not on the privilege to sit at Irving Plaza.

Anyone who wants to party on a Thursday night at 1 AM can go to a ton of other parties where there is no cover and where the crowd is more relevant, young and ready to party until 4.

This event sounds like it was poorly planned from the beginning.

Trigger has been a nightlife fixture for many years. He has done many terrific things. Just recently, he helped organize the nightlife community to battle the neighborhood community boards who were seeking "noise violations" as a reason to terrorize and shut down clubs. YOU'RE the one who's out of touch if you don't know about this heinous development in NYC culture and the fact that there has been a rising up from the nightlife community to battle the oppression. I also left the field wide open for anyone else to put their own stories and experiences. It's called free speech.

All i've gotten from this is1) this sort of event should NOT have been a Thursday night thing, but a Friday or Saturday night thing I would have come into town  for this but NOT on a Thursday night;those days are OVER, folks;and2) Jayne(the Former Wayne) County remains a powerful draw, as she has always been,and obviously was the 'draw' at the packed  Drop Out party;..somehow alienating Richard Manitoba(he was incensed  on Facebook, where he announced HIs plans to "Drop Out") wasn't the wisest move either...Live and Learn..NYC LOVES JAYNE COUNTY!!

Dear Mr. Trigger:

While I understand that your feelings have been hurt and you feel you were mistreated, this public forum, in my opinion, coupled with the ranting emails is not the appropriate forum for resolution. If you have ever seen any of these talk shows these days (e.g., Jerry Springer, etc.), you no doubt know that such tirades get everyone nowhere and, in fact, lead to potentially irreparable damage to all parties involved.

Based on your initial email, my assumption was that this was about business... about money. I know see this is about your feelings, and frankly sir, unless you are a 20-something who is just starting out in the business world (which I assume you are not since you state you have lasted 20 years in the business), you should know better than to air this personal dirty laundry in public like this. If this is about the treatment you received and your feelings, then you should have reached out to this two individuals separately and calmly in some attempt to resolve the emotional aspects of this situation without demands and without such excessive, verbose, threatening emails. If this was about the treatment you received and, more importantly, how you feel about that treatment, this all should have been handled internally.

As for your suggestion that these individuals owe you money, do you have a contract with either of these people? Do you have anything in writing or recorded in some manner that provides proof that you were guaranteed exclusivity to these two performers, Michael Schmidt and Wayne County (I thought it was Jayne County but whoever)? If not, then no... you are not entitled to anything. Zero.

Now if perchance you do have some sort of documentation stating exclusivity, then the next flaw in your argument is the compensation figure. You stated that about 500 people showed up to your event total. You are requesting compensation in the amount of $6,000. This suggests that 600 additional people would have shown up at 1 am and paid $10 to enter on a Thursday night. Since your entire event that started at 7pm and included live performances did not draw nearly this amount (and taking into consideration that some of the audience that paid $25 was likely there because of this Squeezebox and chose the bargain price of $25 for the whole event rather than $10 for only 1/3 of the event), your figure of $6,000 is illogical.

Secondly, you claim that this Tuesday party Dropout stole your business. After a quick Google search, I discovered the location of this party on Vandam St. After checking the public records of this location, I found that the maximum capacity is 220 (at least based on the documentation I found in my cursory search). The advertisements you listed on Mr. Lewis' Blackbook blog state that the Dropout event started at 10 PM and ended at 4 AM. Assuming maximum capacity from the beginning of the party to the end along with a turnover of 50 people per hour (this scenario is highly unlikely based on box office and Broadway show ticket sales for this week, but I will give you the full amount and the benefit of the doubt), this would mean that Dropout on Tuesday, Dec. 13th would have had a maximum capacity for the night of 220 (10-11pm) + 50 (11-12am) + 50 (12-1am) + 50 (1-2am) + 50 (2-3am) + 50 (3-4am) = 470 people. Assuming none of these individuals went to your event (probabilistically unlikely) and all of these individuals were drawn to this event by these two performers Michael Schmidt and Wayne County, that would mean at maximum you would have lost $4,700 to this pre-event. However, this figure of 470 people does not take into account any of the individuals that did go to your event nor does it take into account the other individuals involved in Dropout on Dec. 13th (I count a band, a DJ, two organizers, and 5 "hosts"), so the likelihood that these imaginary 470 people were stolen from you based on the appearance of the two performers Michael Schmidt and Wayne County is almost zero.

On top of that, if your entire event from 7 PM to 4 AM only drew approximately 500 people and was advertised for at least a month in advance (I found an ad for your event on Nov. 17th) and considering that this Dropout event happens weekly, lasts from 10 PM to 4 AM (3 hours less than your event), and changes its advertisement weekly (based on the listings you provided to Mr. Lewis and a Google search), that would mean that you expect us to believe that a weekly event that advertises on a weekly basis at at relatively tiny club (220 capacity) versus your large venue Irving Plaza (1,200 capacity) and month long, paid advertisements had the same total number of attendees... This is completely illogical and improbable.

As for arbitration, unless you have a contract in writing or a recorded verbal contract, you have nothing. You have no right to arbitration of any kind because there is nothing to arbitrate. If these two individuals did agree to arbitration and I were the an impartial arbitrator (which obviously is not possible at this point as I have formed my opinion of this matter) and based on the information you have provided, I would find in their favor. You have provided much detail about your feelings, but feelings have little or no place in this aspect of business.

When you invest in a business venture (as you did in the $6k you invested in Squeezebox), you should only invest the amount you are willing to lose. Even if this is a non-profit venture, the amount that should be invested should only be the amount you are willing to lose. Accordingly, you invested $25k based on your only writings. That should have been the level of loss you should be willing to accept. If you only lost $11k (I know that's nothing to sneeze at in this economy but...), you should be grateful you didn't lose it all (especially based on the flaws I have noted in the planning of this event).

My last bit of advice to you, Mr. Trigger, is to seek legal counsel. I am not a lawyer (although I have studied law), but some of what you have written here could be seen as libel. (Based on the extensiveness of your writing, I would hazard a guess you have written additional thoughts on this matter elsewhere or spoken on this to others in length -- which could be construed as slander.) Calling someone a "creep" or a "jerk" is seen as opinion (usually not defamation), but from my understanding of defamation law stating something like:

"...if Michael S and Derek weren't going to be accountable with me than I at least wanted people to watch their backs with them in future dealings"

could be construed as libel, especially if your statement "wanted to people to watch their backs with them in future dealings" leads to either of these people losing business.

You are stating this as a fact (from how I read it), and if you do not have a contract with these two individuals proving that they acted in an illegal manner, then, in my opinion, it is defamatory and therefore libelous. If you have written other statements like this, that would only add to their ability to sue you for damages resulting from loss of business and reputation, which could end up costing you Hundreds of Thousands of Dollars.

Again, I am not a lawyer, but if I were you, I would find an attorney, show them everything you have written on this matter, and do what they tell you to do (whether that is nothing or whether that is retract statements or whether that is publicly apologize). You could be in for some major legal headaches over what is essentially $1,300 - in the best case scenario for you (see my earlier post with analysis).

Finally, Mr. Trigger, I want you to understand that my posting here is not meant to be "criticism" against you in the negative sense. I don't know you. You could be a swell guy.However, in my consulting work, I often charge quite a bit for this type of "constructive business criticism," which I have given you for free.

I recommend that you review my analysis and perhaps see if there is anything that you can learn from my suggestions on this experience that you can use in future business dealings.

i'm confused by all of this. You paid Michael Schmidt 3 grand to pay all the performers/bands that went on for the Squeezebox portion? Then you suggest he walked away with that money? I assume the performers were paid...no?  So it's not clear to me that anyone scammed you out of anything. The night (sadly) was a bust. That totally sucks...but that's about it. If you hadn't chosen Irving plaza, I don't think we'd be hearing all these accusations. And I'm not sure I would respond to you if you sent me that email (the one above)...you blast out a bunch of pretty harsh stuff. Dear Trigger,

I am a businessman who reads Michael Musto's column. I have nothing to do with this world of nightlife, but I do know business.

Here are my business-related questions and observations:

You state that you spent $25k for the event. 8k went to rent the space until 1 am. From 1 - 4 am, it cost an additional 3k. You provided a 3k guarantee to Michael Schmidt. That's 14k. Where did the additional 11k go to?

Next, if 6k went to the Squeezebox portion of the night... did you really expect 600 people to show up at 1 am on a Thursday to a "party" with a $10 cover charge to see two people who don't even live in NYC (and I assume aren't active in the NYC performance world since they had to be flown in)? I don't know either of them, so you would have to pay me to even leave the house 15 days before Christmas, but maybe you party folks do things like that. 

If only 500 people showed up total as you state above (assuming some of those were comps like in the theater), then the pre-sale of tickets for the early part of the show must have been relatively low. I Googled Irving plaza capacity and it said that this place holds 1,200. (The early ticket sales must have been a huge red flag that this event was not going to be solid financially.)

 Did you think that this lack of pre-sales was going to be made up by the Squeezebox portion at 1 am - 4 am when tickets sales were obviously very low for the live concert event from 7 pm - 1am (a full 6 hours versus 3 hours)?

Let's say all 500 people (that you state were there) paid $25. That's still only $12.5k. You state that you spent $25k. If you made $12.5k with all 500 people paying full price, that would mean you would be out $12.5k, not $11k. Where did the extra income come from?

Let's assume for a minute that the early party two days before was the reason that your celebration was financially hurt.

What percentage of your audience do you think showed up on Tuesday that then did not show up on Thursday? 50%? 75%?

To make myself clear, do you think that only 50% of the people who would have come to the Thursday show showed up?

Do you think that only 25% of the people who would have showed up did?

If you think 50%, then 92 people would have showed up at Squeezbox at your event.

If you think that 25% of the people that should have showed up at Squeezebox were there (based on the actions of this earlier event), then that would have been 184 people at the Squeezebox portion of your event.

If only 25% of the people that would have showed, did show up (and I think that's being generous based on the numbers you have provided for the earlier, longer, concert-format of your event), then you would lost 184 (total people that should have been at Squeezebox) - 46 (actual people that went to Squeezebox) = 138 people that should have showed up at Squeesebox at your event.

If they all paid $10 to get in for the 1 am party only (which I assume some of those people probably came to the full show for $25, but for the sake of argument I will give you all 138 in this scenario), then you would have received $1,380.

Meaning this night is still a financial loss of almost $10,000. You may be out $11,000 but the drama you are causing is only worth (and I think I am being generous here) $1,380.

So all of this fuss is over about $1,300... SAD

No. It's not a sin to expect to recover costs. But any first-year business school college student knows that you only take on the amount of risk you are willing to lose completely. In other words, don't put up more money than you can spare because in the end, you may lost it all.

From what I've read, this event was poorly planned, poorly organized, poorly scheduled, and poorly designed. The fact that Trigger is now looking for someone to blame, other than himself and anyone else involved in the planning of the event is no surprise. It's not the first time that someone has lost money and gone looking for someone else to blame and it's not the last.

It's just unfortunate that such a bully has been given a pulpit to preach such nonsensical reasoning as Trigger.

It's also an even bigger shame that Steve Lewis has lost any "journalistic" integrity he may have had over at BlackBook by acting as judge, jury and executioner with so few of the facts. With only minimal text message replies from one party and a huge email from Trigger, Steve Lewis has crucified potential innocent without having any facts.

One last thing:

If this event was really a Celebration of Don Hill, why is this email from Trigger all about Trigger.

There are a lot of I's and me's in this email and not much mention of Don Hill at all.

If I were in this situation, I would be pissed that more people did not come out to honor "Don," not that I was "shocked" or "feeling violated" because I lost money.

I thought this event was supposed to be for charity... or was it?

well that's insightful. first of all I hate to be cliche or trot out the obvious but: this is fucking America. We don't find people guilty simply based on accusations nor because they choose to remain silent in the face of those accusations. As an attorney, I would advise any client to NOT respond to these allegations, especially on an internet comment board. If they are untrue these guys may have a legal claim against this guy for spewing this stuff. This is not the forum to litigate that. It only gives the spewer more of a platform... as he clearly is not open to any other version of the facts, either because he is blinded by his own blame-searching or is intentionally trying to malign someone one. In either case, responding to that get's one nowhere, and dignifies the outlandish and baseless claims of the accuser. Put yourself in his shoes. let's say for argument's sake michael schmidt got paid his $3000 guarantee and then paid the performers, hosts, flyerers...whoever...then had little or nothing left. From what I've read here, the thing that Lyle hosted was not planned or orchestrated by Schmidt. So these claims come out by Trigger. Right out of the gate he takes it to a pretty nasty (defamatory?) level. The urge is to respond respond respond... But really, think about it. It's not the smartest, sanest thing to do. He doesn't owe any of us internet lurkers any response. Nor does he owe this guy Trigger anything after that screed he publicly unleashed...then pulled the "i didn't want to go public thing"... I know this is a gossip site. I know we all live on the drama. But c'mon. Let's not judge someone guilty because of their silence and the self interested accusations of one person.

The reason this event lost money is that no one cared enough to see a few inactive or unknown bands play for $30 (later reduced to $25).

People are struggling economically. They are out of work. It happened during the holiday season, and the promoter seriously thinks that someone is going to pay a cover charge just to come into a place for a party starting at 1 AM on a Thursday night?

I just Googled the flier for this event and it states at the bottom, "Portion of proceeds going to St. Patrick's Old Cathedral."

What does that mean -- "a portion of proceeds?"

Although I concede that this may now be a moot point being that money was lost on this event for Don Hill, what did the flier mean by "a portion of proceeds?"

90%? 50%? 10% of money made goes to charity? Who would have gotten the rest?

To me this smacks of an attempt at making money on Don Hill's name.

Since when do organizers of charity events plan on making their money back? Isn't that what charity is?

If Trigger did not intend on donating that much money to this celebration/charitable event, then why would he invest so much of his own money in this event? For Don Hill? Really?

This trimmed email reads to me like someone who expected a return on a business venture ... a business venture that went south and lost money instead of making it.
