Setback for Atlantic Yards: Motion to Dismiss Denied
Goldstein et al. v. Empire State Development Corporation is an eminent domain challenge filed against ESDC by a consortium of Brooklyn property owners and tenants who don't want to get booted by Bruce Ratner's Atlantic Yards project. (ESDC is the public authority that's trying to grab the land for Ratner.) ESDC moved to dismiss the suit in August. On Thursday a State Appellate Court "denied without prejudice" ESDC's motion, leaving the suit in play and raising serious doubt that Forest City Ratner can break ground as scheduled in December.
