Fossella Gets 5 Days for DUI, Is Free Pending Appeal

It's strange to consider that Vito Fossella had people thinking as late as September that he might leap back into the 2008 race for his Congressional seat, long after he had been disgraced by a May drunk driving address which revealed he was, unbeknownst to his wife, maintaining a second family. Now Michael McMahon has the seat and Fossella, who was convicted of drunk driving in October, has been sentenced to five days in jail. He won't be going in anytime soon, says the New York Post, as Fossella has filed an appeal for a jury trial. Neither Fossella's wife nor his mistress were present at his sentencing.
