Lady Strolls the Bowery Topless on Hot Summer Day

Sometimes it's so hot you just don't want to wear a shirt, right, ladies? On Monday, one such female took to the Bowery, inspiring a variety of reports from various people on Twitter. Plus photos, because who's not going to take a picture of a nekkid lady (from the waist up) strolling around all devil-may-care in downtown New York City? Bowery Boogie reports that Matt Kosoy saw the woman under the scaffolding at 185 Bowery, where she was walking at a brisk pace and, despite her lack of shirt, had a pocketbook over her shoulder. (Gotta put the credit cards somewhere!) Moments later, Olivia Knoepfel saw her on Prince Street, where she was intercepted by cops and apparently issued a ticket.  Legal or illegal? The law is written by bureaucrats who are pain-sensitive.  They want to stay in office while having the least hassle doing it.  They go the easiest route, with the people who are the most likely to keep them in office, so they can earn those fat retirement checks. If the topless advocates are those people, they will draw laws that would advocate toplessness.  If those people are against toplessness, then the laws will likely against be toplessness. There are the commonsense people and then there are those having a weird sense of rightness, justice. Sometimes, one would wish that the ones feeling the injustice would scream just a little (a lot?) louder, get some attention. We know that the lobbyists do a lot of that screaming in the ears of lawmakers.

  If the ticket was simply due to being unclothed, yeah, it likely will be dismissed.  It only works if it's illegal to be topless in certain areas of the city.

  When are NYC cops going to go after the real criminals in these situations -- all those shirtless dudes with 9 month pregnancy guts and the guys with mega man boobs?  They're the real offenders here.

Years ago, New York's top court ruled (in the "top free seven" case out of Rochestre) that women can be topless ANYWHERE in public, just like men -as long as they're not "performing or behaving in a 'lewd or laciviou's manner". So- any ticket issued strictly for being topless is void. However, who knows what arcane law of regulation (spitting on the sidewalk, jaywalking, etc. ) she could have been cited for?

Why is it that the police continue to ignore the law?  It has been 100% legal for women to go topfree in New York State for over a decade.  We just need more women to recognize that and exercise their civil rights.  Then maybe the police would recognize that they need to enforce the actual law and tell the people who complain that the woman is within her legal rights.

Why are you assuming she was issued a ticket.  Those cops look like they're just standing there and she is asking a question.  Nowhere does the poster of the photo with the cops say that she was intercepted.

RAMONA SANTORELLI AND MARY LOU SCHLOSS, APPELLANTS, ET AL., DEFENDANTS.80 N.Y.2d 875, 600 N.E.2d 232, 587 N.Y.S.2d 601 (1992).July 7, 1992Which the summons will end up being dismissed because the cops violated the woman's rights under the NY State Appeals court Ruling.
