Eric Schneiderman, NY Attorney General, Argues Against DOMA

New York's attorney general is working to prove the federal Defense of Marriage Act unconstitutional. AG Eric Schneiderman filed a brief today, the New York Times reports, supporting Edith Windsor, who is suing the United States because the federal government would not recognize her Canadian marriage to her partner Thea Spyer. When Spyer died the government taxed Windsor's inheritance. Schneiderman's brief states that DOMA "threatens basic principles of federalism," in addition to the fact that it "discriminates between same-sex married couples and different-sex married couples without serving any important federal interest and therefore violates the equal protection component of the Fifth Amendment."
