How Outraged Are You That Former Cop Michael Pena Wasn't Convicted Of Rape?

Former cop Michael Pena beat a rape charge -- but he's probably still heading to prison for a long, long time.
Former New York City police officer Michael Pena yesterday beat a rape charge -- which is the narrative playing out in the media that has New Yorkers outraged. But it's slightly misleading.

As we explained yesterday, Pena still was convicted of three of the top offenses against him -- each of which is a more serious crime than rape, and could potentially land him in the clink for the next 75 years to life.

Pena was convicted of three counts of predatory sexual assault, class A-II felonies. Rape is a class B violent felony.

However, given the rather crass legal definitions of each crime Pena was charged with -- and some suspect jurors -- it is rather outrageous that the jury couldn't reach a guilty verdict on the rape charge.

As we mentioned, despite the jury deadlocking on the rape charge, Pena's still headed to the joint for a long time -- he potentially won't even see a parole board until he's more than 100 years old.

it's unfortunate but we see it so often - idiot jurors who are too stupid to do the right thing - it's almost impossible to get justice with a jury system - because there are just too many idiots out there who could be potential jurors in an important case - what is the judges responsibility - he should be able to overturn, or make decisions - he's the judge!

I'm most outraged that there were 5 lawyers on this jury, 1 of them being Lloyd Constantine - who is the juror responsible for the not guilty verdict,, NY Times reporting this.

Oh man, it's going to be SO SO SO SO SO SO SO awesome when he gets raped repeatedly in jail and no one believes he was actually "raped".

Well, I was outraged this week. But after learning that he is going to prison in May and might be re-tried for what seems to be a solid first degree rape charge, I am not so pissed. But I will say that the jury got fooled. They were presented with a 911 call, two eyewitnesses, a poor defense, and some DNA evidence, which should have satisfied the CSI junkies. But this goes to show that all it takes is one (or several) idiot(s) in the jury room to ruin what should have been a slam dunk.
