Iraq and Afghanistan War Vets Facer Higher Unemployment: Survey

Members of the armed services who have come home face substantially higher unemployment rates than the government claims, an Iraq and Afghanistan advocacy group claims. And 37 percent of veterans surveyed say they know a fellow vet who committed suicide following deployment.

The report comes from Iraq and Afghanistan Veterans of America (IAVA), and stems from a wide-ranging survey of its members. In addition to a higher unemployment rate, the study concludes that vets are also facing poorer mental health support than the government claims as well.

"Nearly 17% of IAVA members are unemployed, which is eight percent higher than the national average as reported by the Department of Labor, says founder and executive director Paul Rieckhoff. "This information should be a wake-up call for all Americans. After 10 years of war, we're losing a new generation of leaders to joblessness. Nearly 2.4 million veterans have been leading the way overseas. It's time for us to welcome them back with jobs so they can continue leading here at home."

In all, some 4,000 veterans replied to the study's question. Among the findings:
The 16.7 percent unemployment rate is higher than the U.S Department of Labor rate of 12 percent.

Twenty four percent couldn't find a job that matches their skill level, and 11 percent couldn't find a job that matches their education level.

Half of the vets didn't feel that bosses wanted to hire war veterans.

Most vets thought the GI Bill, which helps finance college educations was pretty good, but a bunch also complained of bureaucratic delays.

Most don't think the mental health services are good enough. One-third got divorced or broke up with their spouse following deployment and the return home, and 25 percent said their children had emotional problems or trouble in school.

The defense of comparative negligence could be the most challenging defense that the victim needs to counter. Thus, the victim needs to deny any type of negligent action on his part. In the letter, the victim could cite the police report, which indicates that he did not violate any kind of law and there was no evidence showing that he was at fault for the accident. ESIS Incorporated, a division of ACE InsuranceCompany does this as Standard Operating Procedure. They will either drop yourbenefits at their leisure, without notice, or explanation, or drasticallyreduce your benefits. Then when you finally get the forms they provided to theDepartment of Labor(DOL), "Information Copy," it is weeks after thebenefits were affected. If your benefits are terminated, it is over a frivolousunverifiable assumption. Do they have to provide evidence first and get approvalbefore the termination of benefits? NO, they just do it! If you prove theirassumption wrong, they won't change it. ESIS Inc. makes you take them to court,through Administrative Law Judge (ALJ) Review Process. My ALJ review took threeyears!

Then when you win your ALJ case, they useanother entity to conduct a job survey to find the average wage for positionsyou qualify for in your area. ESIS Inc. takes this survey to fix yourwage-earning capacity in the same way they terminate your benefits, behindclosed doors, in secrecy, and without approval. They determine that you couldhave performed positions that you may never have seen your entire life andnever would have qualified for, let alone have been able to perform. But theysaid you could do it—that's that—and as a result they only have to pay twothirds the difference, drastically reducing your benefits. In my case mybenefits dropped almost two thirds.

Even though the ACT specifically allows for theintroduction of evidence by the claimant, ESIS doesn't provide you theopportunity. They make the changes and provide the DOL an Information Copy. TheAct, 33 U.S.C § 908(h) places the responsibility of the establishment of theClaimants wage-earning capacity in the hands of the Deputy Commissioner, notthe insurance carrier, "[T]he deputy commissioner may, in the interest ofjustice, fix such wage-earning capacity as shall be reasonable." NOTE: Isthere any Justice in what ESIS Inc, their law firm, or ACE insurance companiesare doing?

 

Regarding your benefits, the Regional office of the DOL doesnot feel they have the authority to order them back—so along comes yet anotherALJ Review. All along, who is expected to pay for all these legal fees? Theclaimant, because the DOL doesn't compensate Lawyers enough to make it worththeir while. If you live in an area with no Harbors or Longshoremen, there areno lawyers in your area to help. So, you either don't fight or do it Pro Se(Represent Yourself).

If you agree with me, then send a resoundingstatement by not using ESIS Incorporated or any ACE Insurance Companysubsidiary, when looking for an oversea position.  Check to see who your prospective employeruses for their Disability Insurance Carrier. If they use an ACE Insurance Familycarrier, ask if there is another option. Let them know that the Disability Carrier is in your decisionprocess.  If they don't, then think twicebefore accepting the position. For when you are injured in the line of work,you don't deserve to be continually harmed and harassed by the very insurancecompany who is financially responsible for your care.

you'd think we would consider it a public safety issue to make sure these people with PTSD are engaged in meaningful and absorbing activities when they return home from war. Because that might cost tax dollars, I suppose that's something only evil socialists would do.
