Michael Pena, "Rape Cop," Convicted. DA Cyrus Vance Vows "No Mercy" At Sentencing

"In this brutal attack against an innocent young woman, the defendant showed no mercy," Vance says. "At sentencing, we will recommend that he receive none."
Pena was convicted of three counts of predatory sexual assault, all class A felonies, for the August attack. But the jury was deadlocked on whether to convict him of two counts of rape, which prompted Manhattan Supreme Court Justice Richard Carruthers to end the trial this afternoon.
Even without the rape charges, Pena's still looking at
at least 10 years to life in prison for the predatory sexual assault charges. If
Vance gets his way, Carruthers could sentence Pena to 25 years to life,
which means he won't even see a parole board until 2037.
On the morning of August 19, a drunken Pena attacked the 25-year-old victim in the courtyard at an apartment building at 83 Park Terrace. Using his NYPD-issued pistol, Pena threatened the victim into going into the courtyard, where he sexually assaulted her repeatedly in broad daylight.
Pena was caught at the scene -- still zipping up his pants.
Forensic investigators found traces of the victim's DNA on Pena's penis, and Pena's DNA on the victim's underwear.
Pena's sentencing is scheduled for May 7.
