Brooklyn DA Charles Hynes: Scamming Old People Because They're Old Is A Hate Crime

Attention, Charles Hynes: This is a hate crime.
The best part about ripping off old people is that a lot of the time, they don't even know they're getting ripped off.

However, it's still illegal, and, believe it or not, technically is a hate crime -- that's according to Kings County District Attorney Charles Hynes, anyway.

Hynes has charged a 36-year-old Brooklyn man with a hate crime for allegedly ripping off an 81-year-old geezer to the tune of $350,000 in a mortgage scam that started when the elderly victim responded to an ad for debt assistance.

We won't defend the suspect, Sal Lauria, for allegedly scamming a man in the twilight of his life, but a hate crime? Seriously?

According to Hynes, Lauria was working for a company that offered debt assistance for people who have trouble paying their mortgages. After the victim responded to one of the company's ads, Lauria allegedly offered the victim a "streamlined mortgage" -- all the elderly victim had to do was hand over his personal financial information to apply for the mortgage offered by Lauria.

Lauria then used the information to setup a false bank account in his name, and another in the victim's. He then got a $350,000 reverse mortgage in the victim's name and deposited the money into his own account -- and now he's charged with a hate crime.

Under New York state law, a person can be charged with a hate crime if they "intentionally select the person against whom the offense is committed or intended to be committed in whole or in substantial part because of a belief or perception regarding the race, color, national origin, ancestry, gender, religion, religious practice, age, disability or
sexual orientation of a person."

Technically, what Lauria's alleged to have done qualifies as a hate crime -- but it seems like a bit of a stretch for the Brooklyn D.A.

Hate-crime laws were adopted to dissuade people from doing things like dragging someone behind a truck just because they're black -- like the racist Texas hillbillies who murdered James Byrd in 1998 -- or tying someone to a fence and torturing them just because they're gay, like the monsters who killed Matthew Shepard, also in 1998.

The idea behind hate-crime laws is that they apply to crimes that are motivated by hate. In the case of Lauria, the motive appears to be cash, not a hatred of senior citizens.

A spokesperson for Hynes assures the Voice that Lauria's "crime was committed against this victim because he was elderly," and therefore qualifies as a hate crime. However, in reality, it seems as though Hynes sees an opportunity to throw the book at someone, and he's gonna take it.

Lauria's been hit with one count of second-degree grand larceny as a hate crime, the punishment for which can be up to 25 years in prison.

To put that into some sort of perspective, public masturbator/convicted killer Michael Mele yesterday was sentenced to 23 years in prison -- and he killed someone.

Recently a black man stole my wallet, used my charge cards and made my life miserable for 6 months. he was caught on a security camera. when asked why he did it, he replied cause the Ginnie boy seemed like he had money. This really covers the full spectrum of the word CRIME, now doesn't it? In fact when you look the word crime up in the dictionary, this should be the definition.

Oh wait change it, to and include, " I'd like a hooker to my hotel room and oh by the way use the credit card i get for governmental expenses" yeah, its a credit card i use to entertain foreign ministers.  Hey, i just read a story about a bank robber from Long Island who over 10 years robbed 15 banks to cover his over abundant lifestyle. Took 10 years to catch him and over 1 million dollars in theft, guess what? He got 10 years and out in 8. Now I am sure in all the people whose money he stole, consisted of many walks of life maybe even an Apache Indian or two (now that's a stretch Mr. Hynes). how come no hate crime charge for him?

See here is an example that the DA ,sad as it is, has the right to charge a person based on the color of his underwear that morning,  impacting the cost of representation for the defendant thus having to bow out and accept a plea that is loaded with false accusations, mis representation of ethics, law and rights. If, i were an attorney, i would offer my services for FREE to do the same as MR HYNES, (who is just trying to make a name for himself) and research and dig and dig into the DA, their findings, how they have the ability to manipulate people, words and evidence to prove a point?????? just to climb the ladder of success????? Come on, how about the drunk driver who makes a bad decision and kills someone by mistake, God forbid one of your loved ones? Why don't we just get it over with and say Crime no matter how severe is a life sentence. Lets see if we can all live with ourselves. SCHOOL TEACHINGS: We learn from our mistakes. No one taught me in school, make a bad decision and you get sent to a farm in Poughkeepsie and never see anyone again until you DIE. No, we get punished sometimes cracked and sometimes a worse beating, but we learned. Unless we wanted the beating again we did it again and punishment usually increased with the validity of the crime. How about we add up all Bernie Madoffs (premeditated theft to millions of ethnic groups and individuals) 85,000,000,000 billion dollars, 150 year sentence. Now that's an average of 1 2/3 years per billion. Mr. Lauria allegedly mishandled $350,000. GET MY DRIFT?????

This gentlemen made a bad decision and should pay for it with in reason or within the guidelines that have been given to others. We should not look to end his life with a 10,15 or even entertain the print or conversation of 20 years. If he has a family then "we the people" have just dismantled a family and pretty much sentenced the father to death. WE SHOULD BE ASHAMED OF OURSELVES LADIES AND GENTLEMEN.
