NYC Jury Hands Woman Malpractice MegaMillions

The verdict is out and it could make one woman wealthy beyond belief

A New York City jury is forcing three separate hospitals - Jacobi Medical Center (Bronx), Kings County Medical Center (Brooklyn) and the Brookdale University Hospital and Medical Center (Jersey) - to pay a grand total of $120 million to a 45-year-old woman named Jacqueline Martin. According to the New York Times, the verdict's payment is one of the largest malpractice amounts ever sued for and issued in the state's history. 

So what happened?

In 2004, Martin suffered a seizure and was taken to the three separate sites for diagnosis and treatment. After management mess-ups and faulty medications, the New York City woman developed a rare skin disorder called Steven-Johnsons Syndrome and began to experience brain damage due to it. Soon after, Martin's mother was forced to file a lawsuit against the three establishments, which eventually found itself in the state Supreme Court. 

And the jury definitely listened.

The $120 million payment will be split four ways: 50 percent tied to Jacobi Medical Center ($60 million), 40 percent goes to Kings County Medical Center ($30 million), 5 percent on Brookdale ($6 million) and 4 percent to Martin's team of neurologists ($4.8 million). As you can see, there's more than enough blame to go around.

However, the City's Health and Hospitals Corporation is not accepting defeat just yet and plans to appeal, spotting deficits in the jury's decisions. 

For example, Martin made less than $40,000 a year before she was ill and her payment in lost earnings was $10 million; her Medicaid tab was around $500,000 and she got handed $5 million. The Corporation's deputy counsel, Suzanne Bundi, made this point when she said "the amount of this judgment is not consistent with the facts and the law."

If the city is granted its appeal, a huge amount of money could be on the line in a case that affects a whole slew of parties. Runnin' Scared will keep you updated if this story progresses any further.

I feel for this women and her family, and I am grateful thejury did the right thing in this case. I have a son (Ricardo Rivera 5A10) atJacobi Medical Center; he went into the hospital (over a year ago) through theER for a passing gall stone and still there today. He should have been releasedin a few weeks; however, due to gross negligence ((stage IV bed sore, catheterleft on too long that caused a urinary tract infection, urine going into thebedsore causing sepsis, treated sepsis with antibiotics causing jaundice andthen c-diff, then resistance to antibiotics to treat c-diff, operations notneeded when he went into the hospital in May/2011 - that we believe wereblotched, several infections and hospital bugs, scabies (mites) he got at thehospital that bit him alive for months before diagnosed correctly, many falsediagnoses, put on medications for illness he does not have, and the list goeson and on.. including the dental clinic "refusing" to treat him fordental work needed on his teeth that lead my 28 year old son to lose most ofhis teeth and suffers to this day with exposed nerves from teeth that thefillings fell out...about 10 overdoses on pain medication for tooth pain,untreated for Transverse Myelitis which has left him unable to even move hislegs anymore, colostomy bag and tube in his bladder and bed ridden)), and theyshow NO REMORSE. My son has a few nurses and doctors that show him respect andcompassion, the rest treat him like he is a piece of garbage. The hospital evenbrought in a Judge to take away his rights (to leave and get treatment at adifferent hospital) with affidavits full of lies he had kidney failure, whenhis insurance company looked through his medical records (if not destroyed bynow, heard they do that when they are afraid of law suits) he had PERFECTkidneys. I felt like my son was KIDNAPPED by the hospital, and this hospitalabused and used the system (bringing in a judge to hold my son there, based onlies), to protect them from a lawsuit - by taking away my sons rights (and mineas the mother) to sue them, or even get him OUT of there. I prayed with my sonthe other night that Jacobi would be exposed (using the Media), so this articleis an answer to our prayers. The few good doctors, nurses, pca's, front desk/toget passes, and hospital police - I am THANKFUL for. The rest I feel shouldface criminal charges for falsifying medical records, gross negligence,perjury, malpractice, and so on. I also feel the Judge and court appointedattorneys for those staged hearings (to hold patients hostage) should beindicted. Doctors that make false diagnoses to cover neglect and/or testpharmaceutical drugs on patients - should lose their license to practicemedicine. Jacobi "is" the worst hospital in the COUNTRY. There is noaccountability at this place; you report them to 311 and other governmentagencies, and told it is a civil matter and need to hire an attorney. Meantimeyou have to be bed-side with your loved one, and do not have time or the moneyfor any attorney. I hope this person gets EVERY cent they were awarded, and noappeal is granted. Once this hospital (Jacobi) and any others involved have topay up and be accountable for their actions, this abuse/neglect/malpractice maycease. My love and prayers go out to the family that has endured this pain andsuffering, and they are hero's in my mind - to stand up to those that hurttheir family member.  thank them also forpaving the way for others (like us) to see our case is not an isolated case,this "is" the practice of this facility (Jacobi), and until someoneoversees them and makes changes - many more will suffer in that place. Tonight I had to getthe ADN to get a doctor because my son was overdosed, and the nurses did notrecognize it, and on the 19th he was left for four hours without painmedication and suffered. Prior to that video and tonight, he wasover-medicated - they just cannot seem to get it right. And, because thishospital "abuses the system" (using a judge to hold people hostagethere), I can NOT get my son out to another hospital. I plead for help for myson, as I share this. At the same time I feel for the family that also sufferedfrom malpractice at this facility, and is happy that they got the compensationthey so rightly deserved. Honestly, they did not get enough (although somethink this amount was excess), because unless you experience the pain andsuffering emotionally and physically, of malpractice perpetrated on you or yourloved one, from a hospital - you will never know how much it hurts, and thereis NO amount of money that can give you your health back and/or your life back.I have contacted probably every level of government about my son's case, and Ihope that SOMEONE will step in and help him. I could not find a privateattorney to help us at this time.

Are you sure about that Jersey designation for Brookdale? They don't mention any: "The Brookdale University Hospital & Medical Center is one of Brooklyn’s largest voluntary nonprofit teaching hospitals with 530 inpatient beds, an extensive Ambulatory Care Network known as Brookdale Family Care Centers BFCC’s and an Emergency Department and Level I Trauma Center that is among the busiest in the region."
