Colorado Shooting Suspect James Holmes Makes First Court Appearance -- "Freakish" Hair And All

Holmes entered the courtroom -- sporting his "freakish" (as described by Fox News' Greta Van Susteren) orange hair -- and was seated in the jury box with one of his public defenders, away from the families of his many victims.
A solemn-faced Holmes didn't appear to so much as make eye contact with anyone in the courtroom -- including the judge who read him his rights -- but did repeatedly open and close his eyes, as if he were tired and fighting off a courtroom nap.
Holmes hasn't yet been officially charged with any crimes -- today's proceedings were just an initial appearance, at which he was merely informed of his rights. Formal charges are expected to be filed later this week, and will likely include multiple counts of murder.
Holmes, who is being held without bail, could face the death penalty if convicted. Arapahoe County District Attorney Carol Chambers said at a press conference following this morning's court appearance that a decision on whether prosecutors would seek the death penalty needs to be made within 60 days of filing formal charges. As such, she says, a decision is yet to be made -- she says she plans to speak to the families of victims before determining whether to seek the death penalty.
"It is important that we treat [Holmes] as we would treat any other defendant coming into the criminals justice system," she says.
