Horse Carriage Union Tries To Slam D.A. Cy Vance Over Failure To Charge Activist; Fails Miserably

If you're gonna hold a press conference to shame a district attorney into filing charges against someone, you might want to make sure charges haven't already been filed.

The Horse and Carriage Association held a press conference this morning to "say goodbye" to "Oreo," a horse that got spooked earlier this month and raised a little hell in midtown before he could be captured. Three people were injured.

The union also used this morning's press conference to attempt to call out Manhattan District Attorney Cy Vance for not prosecuting a female protester who assaulted a carriage driver a few days after the incident with "Oreo." 

"It's time for DA Vance to send a clear message to NYCLASS that the harassment and attacks on hard-working, law abiding carriage drivers must come to an end," HCA President Steve Malone says in a statement. 

Only problem is, Vance already sent that message -- when he filed three counts of assault and one count of harassment against the woman the day of the alleged assault, which happened nearly two weeks ago.

Seems like a rather significant PR oversight when calling out the D.A. for failing to file charges against a person whom...well...he filed charges against.

According to court document obtained by the Voice, Vance's office hit animal rights activist Roxanne Delgado with three counts of misdemeanor assault and one count of misdemeanor harassment for the attack, which occurred on August 18. The charges were filed that same day -- again, nearly two weeks prior to the HCA's press conference this morning.

Malone insists the press conference was not an attempt to "call out" Vance, telling the Voice his group is only trying to raise awareness of the assaults happening on carriage drivers by activist groups like Delgado's New Yorkers For Clean Livable And Safe Streets, an anti-horse carriage group.

He admits that he didn't check with the D.A. to see if charges had been filed against Delgado, but claims to have already known that they had.

When asked why he would hold a press conference calling for charges that he already knew had been filed, Malone again says "to raise awareness."

The exchange was dizzying.

The PR SNAFU aside, Malone says attacks on carriage drivers are happening more frequently and they need to be stopped. He says another incident happened Saturday, when at about 9:30 p.m., two activists -- a man and a woman -- followed a driver through Central Park harassing him. At the end of the ride, Malone says the man punched the carriage driver in the face -- apparently for nothing more than guiding a horse through the park.

Malone says these types of incidents often go unpunished, and the point of the press conference was to let people know that incidents like these were happening. He says his group has no problem with protesters, but that they "step over the line" when they get physical. He says those responsible need to be held accountable -- which they are, and Malone would have known had he bothered to call the Manhattan District Attorney's Office.

Delgado's next court appearance is scheduled for October 3.

A RECKLESS HORSE CARRIAGE DRIVER, was observed while making an illegal U-turn by crossing a double solid yellow line, in violation of the Vehicle and Traffic Law of NYS, on Central Park South, right in front of the hotel Essex House.

 

SHE DID NOT ONLY COMMIT U-turn by crossing a double solid yellow line, on a dangerously busy street. She was also observed TEXTING ON HER CELL PHONE, WHILE SHE WAS MAKING HER ILLEGAL U-TURN BY CROSSING A DOUBLE SOLID YELLOW LINE.

ALSO, SHE ENDANGERED HER PASSENGERS’ LIVES, TOO… THIS IS UNACCEPTABLE… THIS IS SHAMELESSNESS!

 

The ASPCA, of course, would say that "IT DID NOT HAPPEN IN THE PRESENCE OF ANY ASPCA OFFICER", to summon this reckless driver. Even she was not observed by ASPCA, she was simply seen on this picture what she was violating. Simple is that!

 

Looking at her "fearless" act, she seems she didn't only commit these two traffic violations! She looks “experienced” in violating laws, abusing systems.

Laura, the Coalition to Ban Horse-Drawn Carriages doesn't have "ties" to New York CLASS or W.A.R. That's not a good thing or a bad thing, it's merely a fact. The same way that the Coalition doesn't have ties to the Apple Store or the Statue of Liberty.

"Barn Rules" below is "allegedly" Laura Taylor McFarland or is it Laura McFarland Taylor - - or something close - who lives in Illinois or some god-forsaken place far from NYC but thinks she knows what is going on here.  This person appears to be super angry at life  and what it has given her and spends her waking hours trying to shoot us down.  She is one of those people who - as she says below - has the "link on file" of something I said and continues to misinterpret it.  She has used this before as if anyone really knows what she is referring to.  Well let me explain since I am the author.  It is absurd and desperate and a gross misinterpretation! 

 

Anyone with half a brain interested in this carriage horse issue knows about the Hudson Yards redevelopment project on the far west side of Manhattan and how the land it will develop includes the stables on W. 37th and W. 38th St.    As far as I know, it has nothing to do with NY Class.   But if I were the owner of any of this property and a carriage horse medallion - I would see the handwriting on the wall and look to move into another business. But no one ever called these people smart.  If I were an owner  I would sell that property sooner rather than later when eminent domain may take over and pay them less money.  And yes, Laura  - that is progress - providing housing for lower and middle-income people instead of keeping dilapidated smelly stables on small plots of land benefiting few.   

 

Well Barn Rules, You can save this for your "file"  also.  The Coalition to Ban Horse-Drawn Carriages stands on its own.  I personally have been working on this issue since the early 1990s in NYC.  The Coalition started the campaign to ban the inhumane, unsafe and anachronistic horse-drawn carriage trade in 2006 well before NY Class or any of the other groups were involved - that includes ASPCA and Peta.  We want it shut down for humane and safety reasons – not for any financial benefit.  We are all volunteer and do not get paid for our activism. 

 

WE DO NOT SUPPORT NY CLASS OR THE ELECTRIC CAR PROJECT, WHICH WE CONSIDER A WHITE ELEPHANT AND WILL HURT THE HORSES IN THE LONG RUN.  WE ONLY SUPPORT A TOTAL END OF THE CARRIAGE TRADE AND SAVING THE HORSES TO GOOD HOMES OR SANCTUARIES.  PLEASE READ MY BLOG HERE.

Actually what I find so amusing about all the press yesterday is that the carriage trade is calling attention to the fact that horses are predictably unpredictable and will spook at the slightest provocation and bolt into traffic causing chaos.  .  Nice going guys.  You did our work for us.

 @ElizabethForel It's Laura McFarland-Taylor, as you well know. I've never hidden that I post under TheBarnRules moniker. You also know that I've lived in the tri-state area and worked in Manhattan for years. In addition, I'm actually a horsewoman, something you and your ilk cannot claim.

Nice try but the list of supporting organizations for your group includes the ASPCA, and since the ASPCA “donated” $450,000 to start NY-CLASS you are indeed tied to NY-CLASS. And isn’t it interesting that you and the NY-CLASS folks (in addition to WAR) always seem to be hanging out together on the hackline? But I can certainly understand why you would want to distance yourself from NY-CLASS since one of its (your) regular protestors has been arrested for assaulting a carriage driver. I find it hilarious that the various anti-horse factions have attempted to Photoshop her out of pictures.  

 

Oh! And wait! Is that PETA on your list of supporters? The same group that not only euthanizes over 95 percent of the animals it takes in (even the ones it admits are healthy and adoptable) and, even better, supports horse slaughter?(http://tinyurl.com/83tef56) And, look! There’s H$U$, which donates less than one percent of the millions of dollars it raises to actual shelters and is a defendant in a class action lawsuit under RICO for misrepresenting itself in its fundraising campaigns.

 @thebarnrules  @ElizabethForel  Laura and I'm sure you don't but I would not loose any sleep over the incessant clucking of Elizabeth Forel.  She "doesn't " support NYCLASS but does spend a tremendous amount of time with that green eyed monster wishing that someone anyone would pay her little  group any attention at all. Since she has neither facts or money on her side her group of plain janes are the last to be asked to the ball and it ruffles that ole birds feathers a bit .. you have to forgive her or was that forget her. I personally prefer the later.

The sad thing is, there are COUNTLESS VIOLATIONS THAT OCCUR DAILY against the horses and Mr. Malone knows well that there is no one who does anything about the dangerous actions of the drivers.  There are innumerable pictures of horses and carriages left unattended - illegal uturns, horses eating off the filthy city streets (I witnessed this myself - the driver just threw feed down in the filthy street because he was too God Dam lazy to feed the horse properly) the overloading of carriagaes with too many people not to refuse a fare,  these lazy people are the ones who should be pulling a wagon! These horses suffer from the heaves, so many respiratory problems from breathing in the fumes from the buses and cars. It's animal cruelty - so I can understand the activist's frustrations.  These lazy people should go find real jobs - I pray they all come back some day as carriage horses.

Are you aware that the entire group of horses was vetted by an outside source on the behest of the ASPCA ..and NONE of the horse's showed any symptom or signs of respiratory aliments. I gather that is not information that you bothered to research ..I mean it is rather damning to your "they all suffer from heaves" statement.

We all know that, in reality, this debate has NOTHING to do with the horses – it’s all about money and real estate. NYCLASS was founded by a real estate developer, Steve Nislick, who wants the land the carriage stables currently occupy. As one of the leaders of the Coalition to Ban Horse-Drawn Carriages, a group that supports NYCLASS, has stated: “The hand writing is on the wall. When this industry goes down, it may well be because of the Hudson Yards/Hells Kitchen real estate development project that will wipe out two stables. And then move uptown to take the others. Manhattan real estate is very valuable and many developers have their eyes on the redevelopment of the far west side. You can rant at NY Class and the ASPCA all you want – but you can’t stop this kind of progress.” (link on file)
