Raymond Roth: not dead -- and likely facing charges.
The son of the Long Island man who failed to fake his own death last month was arrested this morning on charges of conspiracy to commit insurance fraud for allegedly helping his old man in his bogus drowning scam -- which cost taxpayers tens of thousands of dollars after authorities spent days scouring the ocean looking for the "missing" man.

Jonathan Roth, 22, told police that his father, 47-year-old Raymond Roth, went into the ocean at Jones Beach on July 28, and never came out. The report prompted the pricey rescue effort, which went on for about four days.

On Thursday, authorities found Roth...speeding down a highway in South Carolina, not at the bottom of the ocean.

Since it was determined that Roth faked his own death, it's been revealed that he was in communication with his son -- his wife claims to have found emails the two exchanged detailing the scam.

As rescuers tried to find Roth -- and his wife, Evana, was under the impression that he was dead -- the unemployed former manager at a Manhattan computer company was livin' it up at a resort in Florida. He's still on the loose, despite telling authorities he would speak with them once he returned to New York.

According to an affidated filed this morning, "[Jonathan Roth] stated ... that he saw his father walk into the ocean and walk in chest high. The defendant was present when a massive search of the waters and area was conducted."

Prosecutors added that "The defendant at all times was fully aware that his father never walked into the water and had in fact driven off in his personal vehicle."

As we mentioned, Raymond Roth remains on the run, and likely also will face charges in connection to his bogus drowing.

Jonathan Roth is being held on $10,000 bail. If convicted, he faces up to 15 years in prison.
