A Woman Sues New York City After She Was Arrested for Going Topless in a Brooklyn Park

Despite the February memo telling NYPD officers not to arrest topless women, some cops seem not have gotten it. Jessica Krigsman is suing the city over her arrest for going topless at a Brooklyn Park last summer, even though the practice is legal in New York City.

The suit relates to a July 2012 arrest in Gravesend's Calvert Vaux Park, when Krigsman was approached by two NYPD officers who asked that she put her shirt back on.

Krigsman refused, citing the 1992 appellate court ruling that made it legal for women to go topless in public spaces in New York City.

One officer told Krigsman to "stop mouthing off." When Krigsman refused, one officer (it's unclear if its the same one) tried forcefully pull Krigsman's shirt back one while handcuffing her, alleges the suit. Krigsman has not responded to Runnin' Scared's request for comment.

The charges against Krigsman were dropped that October. But now the city might ~*~*~*lose its shirt*~*~*~ over Krigsman's suit, filed in Brooklyn Supreme Court on Monday, which alleges civil rights violations, malicious prosecution, assault, and battery.

Krigsman's Facebook is full of photos of her topless in places, as is her right as a New Yorker. And Runnin' Scared certainly salutes her body positivity. But, uh, maybe Krigsman should check Facebook's terms of use?

I believe all people have the right to go topless and bottomless if they so desire. Why are people so offended by nudity? We all have the same things! I would like to see people stand up to the oppression of the state and city  and stage a nude demonstration. Is there anyone out there who has the organizational skill to dot his?

People "jail" their pants as a fashion statement.  While it originated in prison, it had nothing to do with anyone's status, or lack thereof, but rather was simply a result of not being allowed to have a belt.

Sounds a bit as though you spent an uncomfortable night somewhere hoping mom would hurry up with your bond.

Except that when the pants are "falling off their asses" in public, their actual asses aren't showing...just their boxers. I feel the same way about women with very low self esteem who wear low cut jeans with a thong peeking through, but I don't hear any complaints about that. Seems a double standard is rearing it's ugly head...

Personally, I don't care for seeing anyone topless in public (male or female). However, here is a question, for those of you who support this law and if you participate in it, how would you feel seeing a total stranger take your photo? Would you feel violated or offended? What if you ask the person to erase the photo and he/she said no, since its a public place and there is no expectation of privacy in public. How would you feel? Just curious.

Boring...I'm not sure why many Americans are so hung up on nudity. I was on San Diego beach a few yrs ago (topless) and not flaunting myself but sunbathing. When I wanted a swim I would put my top on and yet I was asked by the 'boob patrol' not to sunbathe topless. Weird!! In Europe no one is offended by seeing a few boobs. OR so long as its done discretely no one gets offended by breast feeding in public....

When someone wears their pants falling off their asses in prison, it means that person is 'taken' as their 'bitch'. When guys wear their pants like this in public, they should be arrested for indecent exposure!!! NO ONE wants to see that and kids should definitely NOT be exposed to it!

Sorry It's not your right to be in public and see what you think is "Proper". Maybe people find looking at you offensive, but that's too bad because you have a right to be in the park also. I see plenty of homeless on the streets and in the parks who haven't washed in years, should we arrest them also. I see young kids screaming and crying and that is more irritating to my senses on a beautiful summers day then a girl without a top.

I can't believe so many of you are bitching about this girl. It's the law in NY that she is allowed to walk topless and she basically got arrested for doing nothing wrong. the cops should focus on capturing criminals not harassing people for not breaking the law. They were basically bullying her and I'm glad she stood up to them. If they did that to me I'd tell them to F*** off also.

Eh, not too smart. I understand it's my right as a woman to walk around with all types of shit hanging out and to do with my body whatever the ehll I want, woo hoo women's rights. But, I don't want to make myself an ez target to some schmuck that doesn't know how to act, the cops have their hands full as it is, without this attention troll adding to it, buy getting herself hurt.
