Transcripts: Bronx Teen Catches NYPD Lies on MP3-Player

An NYPD detective is facing perjury charges after he denied that a suspect made statements to him before being charged. The detective's sworn testimony fell apart after the defense produced recordings that the defendant secretly made using an mP3-player, like this one, during his time in custody.

When arrested on Dec. 31, 2005 for shooting a man on Christmas day in Parkchester, the accused teen, Erik Crespo, surreptitiously taped Det. Christopher Perino’s hour and 15-minute interrogation using an MP3 player. However, when the case went to court this past April, Perino, 41, denied when asked by the prosecutor if Crespo had made any statements to the detective prior to being charged in the shooting.

That turned out to be a problem when, the defense witness produced recordings to the contrary.

Under cross-examination by Crespo’s attorney, Mark DeMarco, Perino denied 11 more times that he had any conversations with Crespo after he was in custody.

“I never interrogated your client, sir,” Perino told DeMarco.

After questioning Perino, DeMarco turned over the MP3 recording to the prosecutor prompting the district attorney’s office to drop the most serious charge of attempted murder. Crespo eventually pleaded guilty to illegal possession of a gun.

The detective was indicted on 12 counts of first-degree perjury, each count of which is punishable by up to seven years in jail. Though it’s probable that Perino will never do any prison time, with less than a year to go before retirement, the detective can likely kiss his pension goodbye.

The following is selected portions of a transcript made of the MP3 recording, which strongly supports Crespo’s self-defense contention.

“This case just supports the call that all interrogations or interviews of people in custody to be recorded,” DeMarco said.

(As the interrogation ends, Perino tells Crespo why it’s important he get a written statement from the teen and not just testify about their conversation.)

I think the detective did a fine job getting this statement. Unfortunately he lied about it, we'll never know why, and the case went into the toilet. Be clear, this is not a forced confession.

From online reading (so YMMV): Citizens in certain states who try to secretly record interactions with the police have been slapped with additional charges for making the recording without both parties' knowledge. *Especially* if it makes the police look bad.

DISGUSTING! As a former NYPD cop myself, that worked in the Bronx; and was fired after I myself recorded police abuse and corruption and reported it I'm glad this kid recorded this scumbag detective! I hope he made a CCRB complaint as well for abuse of authority.

As always - it's the rotten apples that ruin life for the thousands of good ones. Think about cops, lawyers, etc. They've got to live with a bad reputation, no matter how honest and hard working they are - just because of scum like this cop. People tend to think of everyone in a group like the worst one they've heard about. Thanks detective for making putting a stain on the entire NYPD.

I didn't think the Detective was so bad. Obviously, the interview was not used against the defendant in court, or the detective wouldn't have denied it. So, how was the accused harmed? If anybody went back on the Det.'s offer of leniency, wouldn't it be the DA who brought the charge?

I understand it's perjury, but not sure how the detective "wronged" the accused. Confused.

The kid still accepted a plea bargain to go to jail for seven years for a weapons possesion violation. He should have had no charge at all for defending himself. If the story is the way the cop seemed to believe, based on the video tape, then the shooting was a justified case of self defense.

Until a year and a half ago, I lived in the Bronx.

What is interesting to me is that the D.A. and the detective seem to be prosecuting a young man for defending himself against a violent gangster.

Yes, they are being "tough on crime", because handguns are illegal, and the defendant seems to have had a criminal record. But the facts of the case would seem to mitigate against prosecuting Mr. Crespo, unless, perhaps, he was in serious violation of a parole agreement or something along those lines.

Justice does not appear to have been served in this case, quite apart from Det. Perino's interrogation and subsequent perjury. There is rough justice indeed in New York, and it is apparently served up by the criminal justice system itself.

I'm a conservative on crime issues, and this crap is outrageous. (Do we even know how to be genuinely outraged any more?)

As an Illinois resident, I've seen our death penalty cases torn to shreds by careful investigation. It's clear that neither prosecutors nor police nor defense attorneys are interested in the facts. They're interested in winning, period.

And the detective who perjured himself a dozen times won't go to prison. How sweet!

Simple proposal: if police or prosecutors commit or suborn perjury, withhold or fabricate evidence, etc., the individuals involved must serve the maximum possible sentence the defendant was subject to. In other words, fabricate evidence in a death penalty case, go to death row yourself. In this case, the detective should be sent up for 25 years.

Does anyone know what the motivation to lie was? It seems like the officer would be proud of this interrogation.

The most likely scenario seems to be that information from this interrogation was used to obtain vital evidence and in some way this interrogation was illegal. That would motivate the cop to lie about the source of the information that lead to the evidence.

But what was wrong with the interrogation?

I can think of a number of reasons why Det. Perino would have liked to have lied about the interrogation, none of which have to do with whether or not the interrogation itself was illegal or illegitimate.

I think the simplest explanation is that he viewed himself as being in a contest of wills with whomever would be the defense attorney, and he was just cutting corners in a way that he thought was both convenient and impossible (ooops!) to catch.

Think about it this way: why not have every interrogation taped and videotaped? It is certainly not a technological problem; it's something that could have been done (with film) fifty years ago. It's because the ethic of winning in court trumps the ethic of transparency/disclosure. Det. Perino just took that attitude and stepped over the line that police are not supposed to cross.

If we think it's important for the police to play by the rules and not perjure themselves, we need to ask, "Who's policing the police?" If they are responsible for policing themselves, then Det. Perino will not be an isolated case.

I agree with your post... to a point. It is true that the police and the DA are not concerned about justice; only convictions & confessions no matter how obtained. The greatest truth is that the police are racist pigs & they think that they won't get caught. Just visit any criminal court in any of the five boroughs on any given day and you will see what I mean. You NEVER hear of this kind of thing happening with a non-black or non-hispanic Defendant. You NEVER hear of fatal shootings by the police in white neighborhoods. You NEVER hear of over zealous and profiled stop and frisks of whites on the streets (to the level that it happens with blacks). You NEVER hear of cops beating up white people. You NEVER ... well, by now you get my point.

Why? Because perjury on this level does not involve money but human LIVES! I'll bet that if a cop knew that lying about an arrest could subject him/her to the same level of punishment, he/she would think again.

Does anybody know what has happened with this? Did the charges against detective Perino stick? (note the small "d"). Did he plea? What about the rest of the police force ... I'm sure that Perino is not the first!

The reason that the cop will not be prosecuted for prejury or no one is outraged is because the kind of stuff happens every day and will continue to happen. What's happened to this young man is the norm in this country and in our society. What is not normal is for the public to hear first hand accounts of it.
