Queens Anonymous Member Gets a Letter from Scientologists

That's Mike Vitale. Guess the costume didn't work too well.

When Queens resident Mike Vitale was outed as a member of Anonymous by the Church of Scientology last month, he specifically asked Church members if they planned to prove his criticisms correct by declaring him “fair game” and subjecting him to the threats and intimidation that are said to be inherent in that Church policy. Would they threaten him or show up at his house?

Well, they did—or, at least, their lawyers did.

Yesterday a letter from the Scientology-connected law firm of Rabinowitz, Boudin, Standard, Krinsky & Lieberman was hand delivered to Vitale’s home. In it, Vitale is accused of being a ringleader of Anonymous, read a list of the alleged crimes of the loosely-knit group, has those crimes laid at his own feet and is warned to cease his activity with the group, or else.

“We place you on notice that inciting violence against the Church and its members, and engaging in acts of terrorism (such as the simulated anthrax attack, bomb, arson and death threats) violate State and Federal law,” wrote attorney Eric Lieberman. “We demand that you refrain from committing, or assisting others in committing, any illegal acts directed at the Church or its parishioners. Should Anonymous continue inciting others, and/or engage in violent acts against the Church or its members, we are prepared to take whatever steps may be required to protect the Church, including referring any individual who commits such acts, or aids and assists others who commit such acts, to State and Federal authorities.”

Lieberman said that Vitale was not the only New York-based Anon that had received a letter, and that the letters do not mean that the Church has not gone to the police as well. He added that the purpose of the letters is not to discourage protest, but to put a halt to the alleged illegal activities, and encouragement of illegal activities, of Anonymous.

But what exactly constitutes such encouragement? Would using a bullhorn at a protest qualify? Lieberman said no, and explained the stance of his client a bit further.

“If you’re manning a bullhorn at a protest and saying ‘burn the Church down,’ then that’s encouraging the illegal act. If you’re manning a bullhorn at a demonstration, assuming it’s legal to have a bullhorn at a demonstration in front of the Church, if you’re merely manning a bullhorn and saying ‘we don’t like Scientology,’ then that’s not illegal,” said Lieberman.

Though Lieberman would not answer when asked how the Church came to know Vitale’s identity, it likely stems from his role as de facto liaison between Anonymous and the New York Civil Liberties Union during the March 15 “Operation Party Hard” protests in Manhattan. Vitale said he, nor anyone he knows, had anything to do with the alleged threats against Scientology, describing the letter as “ridiculous scare tactics.”

“As a matter of fact, it’s because of these kinds of tactics that I protest against them in the first place, it is as expected as it is predictable,” said Vitale.

The Church of Scientology’s official position is that “fair game” no longer exists, but critics of the Church disagree, arguing that the harassment of critics continues on at least in an unofficial capacity. On Saturday Anonymous will hold “Operation: Fair Game: Stop” rallies at Church outposts across the world, designed to bring attention to Scientology’s harsh treatment of its critics. Vitale said this letter could not have come at a better time. With just days before the “fair game” protest, Scientology proved Anonymous’ point.

“When I read the letter, I got the joke,” said Vitale. “This will in no way deter me from showing up to any Anonymous events, and I may even put more time into fighting the Church.”

Lieberman insisted that the purpose of Vitale’s letter, and the similar letters sent to other Anonymous-affiliated individuals, is not to quash dissent. “The purpose is not to stop people from engaging in protected activities, or encouraging others to engage in protected activities,” said Lieberman. But Vitale said that the implication was to shut down any protest by casting extremely broad accusations of criminal wrongdoing against the handful of protesters Scientology can identify.

“They can think what they want, but if any real investigators or the police took any interest in investigating these slanderous allegations against me by the church, they would quickly find out the truth,” said Vitale. “I invite them to do so, and decades of so many false allegations against Scientology critics have robbed the Church of any legal credibility in this department.”

He added, “We’re beating them by telling the truth so they have to lie, and these acts of desperation aren’t fooling anyone.”

I hope that the law firm of Rabinowitz, Boudin, Standard, Krinsky & Lieberman has charged the Cult top $$ for this bit of comedy.

I have been to anonymous protests and have participated in their internet forums, including epicanon.com and I have never once seen anything even remotely resembling the encoragement of violence or the commission of any illegal acts. In fact, from what I observe, the people organizing and participating in these protests are scrupulously careful to make sure that every single act of protest they participate in is legal--including whether or not it is legal to write messages on sidewalks with chalk (something NYC children enjoy on a daily basis in all neighborhoods).

For Eric Leiberman to (ahem) use the rhetorical example that it would be illegal to use a bullhorn to call for people to burn the church down is a transparent attempt to suggest that anonymous protesters against the fraud and human rights abuses committed by the Cult of $cientology have in fact done so.

Of course they haven't, since at the Cult's own insistence, there has been a large NYPD presence at each of the protests, and if such a statement had been made over a bullhorn, said anonymous protester would've already been arrested, not only for inciting violence but for using a bullhorn..

Because. At the Times Square church, the NYPD has not issued a bullhorn permit, and so anonymous protesters have not used a bullhorn there.

Eric Lieberman should do his own research into the Cult he is representing. Does he know that the Cult says that psychiatrists are responsible for the holocaust and not Nazis??????

Google is his friend but if he is lazy or pressed for time, he could could ask one of his assistants to print some info at Xenu.net about the Cult's practice of Fair Game. I realize that even criminal cults have a right to legal representation, but such legal representatives would do well to do some research before the fall too far into the rabbit hole that is $cientology.

A lot of Anons around the world have been getting these snarky "scare-o-grams" from various law firms in Scientology's employ.

Clearly, they're meant to intimidate and scare people away from protesting. This is a widespread campaign by Scientology to suppress freedom of speech and freedom of assembly.

If any crimes had been committed by the people receiving these letters... they wouldn't receive a freaking letter -- they'd be arrested.

Not only does this prove the point of our next protest, but this also is an act of libel by this so called "church". They are accusing him of being a leader and directing these threats, which he certainly has not. Anonymous has no leader. The top brass at scientology, an organization that is structured much like the SS, simply cannot envision a movement built off of leaderless resistance. They cannot fathom how such an organization can exist because their own organization is little more than a serious of calculated moves thought up in meetings and going through an approval process. Everything scientology does goes through a committee and is approved by those in charge. Not a thought can go through a members head without approval. They can't imagine how anything can get done without some smoke filled room full of leadership behind it. This is why they fail to handle Anonymous. We are legion. We do not forgive. We do not forget. They can continue to expect us at our peaceful and zany protests no matter how much they snow us in with legal libel.

As a Scientologist I used to believe that Fair Game was a thing of the past. I was told that those people were purged from the organization long ago.

So imagine my surprise as I now find out how many people are receiving these letters, all over the USA! And for what? Peacefully marching? Hey, I might be a Scientologist, but I'm also an American and I respect and uphold the values of freedom of expression and freedom of religion. From what I have really seen, these protestors are not stopping anybody from practicing Scientology. But they are stopping the greedy spiritually bankrupt members of my organization from getting away with decades of lying and manipulation!

It's about time for the leaders of Scientology to take responsibility for their crimes. David Miscavige worked tirelessly to surpress the truth about the death of Lisa McPherson at the Flag Land base in Clearwater. Bitty Miscavige ignored warnings that the Freewinds cruise ship was loaded with deadly blue asbestos and allowed Scientologists to pay for the privilege an extremely heightened risk of contracting Cancer or Mesothelioma.

Fair game is happening right now to Anonymous protestors in LA (False Report, Charges Dropped,) in Boston, (Charged with Harrassment, Trespassing (dropped.))
People who happen to live or work near Scientology Orgs during Protests are receiving this crazy letter, too.

What really gets me is the notion that all this time the money I was giving to the Org was being funnelled not to feed the hungry or teach the illiterate, but a HUGE amount of my donations have funded LAWYERS and PRIVATE INVESTIGATORS!!!

It's almost enough to make me want to join the protesters, but I have some small hope that I can do more from my present position.

Thank you for this, Village Voice. I think it's important to let people know that the CO$ is actually doing this worldwide. The exact same letter was received by an Anon in Auckland, NZ from their Auckland firm. They tried to get the personal information of the person that contacts council for us, were refused, took it to the ombudsman and were refused again. So they used the name of a young man that they already had.

Intimidation tactics as usual. The one thing they didn't count on is that Anonymous is not afraid of them.

Again, thanks Village Voice. I hadn't read your paper since I moved out of the States years ago, but have now favourited the site and will be visiting regularly!

The cancellation letter of Fair Game only got rid of the name "Fair Game," it goes on to say that it does not change how the Corporation of Scientology handles SPs. Their practices of intimidation, harassment, and humiliation are still very alive.

This letter is clearly trying to scare people away from protesting. Immediately labeling protester terrorists, blaming them for actions they have not made, and threatening legal action if they "continue" what their actions- when the only observable action they have done is peacefuly protest- is intimidating. They have sent these letters indiscriminately- to anyone who they manage to find their real identity. There is nothing to prove or any evidence to show that these people have done nothing more than peacefully assemble, but they accuse them anyway.

They also admitted that they have sent out multiple letters of this nature. I hope they get paid enough so that they don't care that they are going to be sanctioned.

It may be just my 15 years in law talking, but you the New York Bar simply will not allow attorneys operating in this state to send out spam mail alleging series crimes with no factual support, with the obvious intention to stop people from excessing their right to free speech. I note that counsel is on notice of the COS's past conduct in terms of its felonious fabrication of threats against itself. Counsel, I'm about to help some friends and eat your lunch.

For an organization that prides itself on understanding the human spirit, they certainly don't understand what is driving the Anonymus movement. Every time one of these letters goes out it brings in more people. Each person who receives one of these bits of nonsense strengthens their resolve and understand better how Scientology is a threat to free speech and free expression.

Hubbard left an untenable legacy, "always attack, never defend" is a grade-school dictum that should be left on the playground, not brought into a world of adults.

The letter mentions a bomb threat that was posted on Youtube. This bomb threat was mentioned in a Church of Scientology DVD "Anonymous Hate Crimes". I have a question for you Church of Scientology? If the supposed video was pulled off of Youtube like you claim, why is it of higher quality on your DVD?

A real "church" would be spending those lawyer fees on helping the homeless, feeding the starving, building fair-wage/sustainable industries etc. Instead hundreds of libelous letters full of unsubstantiated allegations have gone out to people across the US and all over the world who are simply exercising their civil right to free speech. I just checked Mr Lieberman's CV and it seems that he has had a rather illustrious career litigating for 1st amendment rights. Which it makes it all the more ironic that he would sign his name on a letter that he obviously did not draft (being that almost identical copies of this letter have been sent to Anonymous protesters in many cities around the world, always timed to be hand delivered about 1 week before a scheduled protest).

I am really hoping that he did it for the $$$, and is now enjoying the lulz being had at his expense.

Eric Lieberman, according to his website is the attorney who represented (along with the late Leonard Boudin) Daniel Ellsburg and James Peck, "one of the Freedom Riders brutally beaten for attempting to integrate interstate buses."

Guess what?

That doesn't work anymore. The many abuses of Scientology, from kidnapping and severe child labor abuses to forced abortions and breaking up families, are coming to light. A simple search at Google or Yahoo or MSN will return page after page after page of examples, court documents, and video.

Thanks to the Internet, these secrets and many more can no longer be hidden, and the formerly isolated sufferers of Scientology's policies of fair game and disconnection can now unite.

And thus, anonymous.

thank you for your article on this and for your other articles exposing the truth on scientology. Every Step in our path is made by small events like this. As a side note, many people receive these types of letters, I personally know of at least six that have received Cease and Desist letters including the "ringleader" (their words, not the truth) of the Minneapolis protests. many of these people also have letters to their family or parents along the lines of "Do you know your son/daughter/wife/husband is encouraging Illegal activities?"
They obtain people's Real names though protest permits, police questioning, and Private investigators. This is the reason that protesters wear masks at the protests.

"The practice of declaring people FAIR GAME will cease.
FAIR GAME may not appear on any Ethics Order. It causes bad public relations.

As you can see, it does nothing of the sort. I also found this quote from John Atack's "Hubbard and The Occult":

"In USA v Jame Kember and Morris Budlong, in 1980, Scientology lawyers admitted that despite public representations Fair Game has never truly been "abrogated" (sentencing memorandum, District Court, Washington, D.C. criminal no. 78.401 (2) & (3), p. 16, footnote). The Policy Letter which did eventually cancel it, off 22 July 1980, was itself withdrawn on 8 September 1983. Unknown to MOST of its adherents, Fair game is still a scripture, and according to Hubbard's Standard Tech principle binding upon Scientologists."

The letters I've seen are clearly a form of intimidation, especially when sent to the parents of "children". Although the wording is quite clever to avoid explicit accusations: "you have been indentified as leading or directing actions of anonymous, which may include its campaign of actual threats and incitements", side steps the accusation by stating a reasonable perception ("identified as leading or directing...") followed by an associated belief ("which may include..."). Thankfully such letters do not work on the majority of anonymous as they have enough smarts to know to protest the church and so enough smarts to see the letters for what they are, huffing and puffing.

The beauty of Anonymous lies in it's organization, or lack thereof. What Scientologists can't understand is that Anon HAS no leaders to speak of, just a general direction in which the legion of people that make up the group decides to go.

They can say that the people that are outed are Anon leaders, but the minute on Anon falls, another will take his place, doing his job, even more committed to the cause due to his fallen /b/rother.

So, the actions of the attorneys sending these letters to harrass protesters is in direct violation of the creed scientologists supposedly live by. Thus proving bias on any communcation related to anonymous supplied from the executive level to the lower orgs.

For the studious scientologist that takes his/her beliefs seriously - you really should run this information properly thru a Doubt Formula after taking the time to become informed about the issues that are uniting thousands of people in AGREEMENT that the C0$ is corrupt at the highest levels. And while running your doubt formula on Anonymous, be sure to evaluate the fact that lots of money is being spent on suppressing free speach thru attorney actions such as this. How is that helping people?

After researching the evidence for your doubt formula, once you come back to present time its not that hard to see 2 out 3 points of the ARC triangle are weak. So obviously the big picture reality is not what you've been taught to see. Anonymous has initiated communication in the form of peaceful protests, will you be willing to receive it per ARC?

Furthermore, Anons can only wish their efforts were funded by Pfizer and the other drug companies. Fact is those companies have better things to do with their money. If we truly had their financial support we'd be concentrating on bigger things with more immediate impact than picket lines... we'd have massive class action suits being instigated on behalf of the escaped victims of neglect and abuse, and we'd have the government raiding Gilman Hot Springs, CA to get the 30+ prisoners of SP Hall free from their captors who's sole job is suppressing their hostages basic right to live a free life while breaking every rule there is in your Creed. Oh well, so much for "no agency less than God has the power to suspend or set aside these rights".

I encourage the Village Voice to continue it's awareness and to expand it to include the active censorship currently being utilized at Oprah.Com blogs as well as the blog for the Claire Hoffman attempt to minimize the German government's report that Scientology in the form of it's business propaganda arm WISE is attempting, short term goal "economic domination" and long-term "to achieve total control" of the German government and society.

When these issues are brought up on the Washington Post or Oprah blogs, they are deleted within 24 hours based, at least on the Oprah site, in a justification of "religous hate speech will not be tolerated."

Strangely, non-factual statements of opinion and "personal experience" by Scientologists themselves are in plentiful supply and directly violate the TOS on these sites by attacking others personally for their factual belief sets.

I suggest others do the same.
