City Repeals Tax on Freelancers -- But Albany Hits 'Em With Another

Last week the Freelancer's Union sent an email encouraging its 75,000 members to go out and stump for Michael Bloomberg's reelection campaign. "Will you join us?" asked Union president Sara Horowitz, who said she'd be volunteering personally. The group is supporting Bloomberg because earlier this year he delivered on a signature issue -- citing the impact of the recession and freelancers' lack of safety nets, he was able to push through the city council a bill that exempted sole proprietors from a tax on unincorporated businesses that was costing many freelancers thousands of dollars a year.

But as of this coming Monday, much of those hard-won savings are going to be offset by a new tax that hits freelancers and sole proprietors hardest of all...

The revenue from this new tax goes right to the beleaguered MTA, which estimates that it will generate just over $1.5 billion dollars over the next two years. Under the Metropolitan Commuter Transit Tax, freelancers, businesses, and even school districts will have to pay 0.34% of their income ($34 dollars on every $10,000 of income), whether they use the subway or not. For freelancers, unlike people in the other two categories, the tax is retroactive for all of 2009.

With all the freelancers in NYC, one might be surprised to learn the sponsor of this bill is Brooklyn's own Martin Malave Dilan, a Democrat. (The item didn't get much notice when it was slipped into the budget in May.) Dilan and others argued that this tax is necessary to prevent fare hikes for the cash-strapped agency, which got itself into a financial pickle because it borrowed excessively and couldn't pay its creditors.

A clerk in the state's finance department told the Voice that a hotline the agency set up to explain the new tax has been flooded with complaints. Freelancers Union president Horowitz is complaining, too. In a statement to the Voice, she said the tax "definitely adds unnecessary administrative burdens... Since the first payment is due on Monday, we're using our website and networks to get the word out about the tax this week, to make sure our members aren't blindsided with late penalties on top of an unexpected new tax."

Not a news article. More like an op-ed piece.

Do freelancers not benefit from transit like all other workers in the counties served by the MTA?

And let's get our reporting right. It's not just the subway that is supported by this tax. There's two far reaching regional train systems, numerous bridges and tunnels (some free!), along with the nation's largest bus system. We all rely on the MTA for the economy to function.

And the riding public does benefit too. Fares in NY are low compared to other cities in the US and around the world. Rides with an unlimited MetroCard are still around $1.15-25 per ride for many New Yorkers (average). That was the average per ride fare in the 90s. Given how low fares are in NY - alternative revenue streams such as this modest tax are hardly something to complain about.

One might argue MTA mobility is VITAL to the freelancers career in particular. Imagine how much more expensive it would be to have to own a vehicle, purchase fuel, insurance and obtain parking (you work for the Village Voice right?)

How does this hit freelancers and sole proprietors "hardest of all"? Paying taxes and completing paperwork is a fact of life for a business owner, and that's what a freelancer is.

Finally, are you seriously suggesting that $34 per $10,000 is a huge burden? If a freelancer makes $60K per year - this transit tax amounts to $4 per week.

We all need to pay our fair share to maintain one of NY's most important assets. And if you don't want to benefit, I suggest you move somewhere else where those amenities are not part of the mix.

Next time I'm looking for some freelancing help, I'll ask if they belong to this so-called union (which is really a mailing list, not a real union). If they do, they're not getting hired. Any "union" that helped bring back Bloomberg and Quinn deserves to be shunned.

Freelancers already pay a lot of taxes. Most of us also don't even have health insurance. As a freelancer in New York, I have to use taxi's because I haul too much equipment which is necessary to do my work. So now I have to pay for that transportation as well as subways that I don't use for work related travel? I don't mind paying a tax that all other residents pay, but not a penny more. Bailouts are only for huge corporations I guess. Screw the independent business person.

why not put responsibility for this "tax" on the backs of those who circumvent use of the mta by driving into manhattan? those of us who live here--freelancers or not--pay for the mta, not only through direct payment for the rides we take, but via our tax dollars, as well. if you want to drive your car in from westchester, nj, and other outer boroughs, instead of patronizing public transport, then a pay a fee for taking up more space here (and slowing the pace of buses to boot). freelancers and sole proprietors pay more tax than they would if on payroll. enough!
