Judge Dismisses Willets Point Suit (Updated)

It's been a bad week for New Yorkers trying to keep their property. First there was the Atlantic Yards decision, which upheld the seizure of citizens' homes and businesses for the Ratner boondoggle. Now Brooklyn Federal Judge Edward Korman has thrown out a complaint by Willets Point landholders who'd hoped to reverse a redevelopment plan that would force them out establish intentional neglect of Willets Point and deprivation of their equal protection and due process rights [see note at end].

The judge was sympathetic to the complaints of the Willets Point Industry and Realty Association, who brought the complaint and whom he acknowledged had indeed established "thriving businesses" in the Iron Triangle near Citi Field, notwithstanding that "Willets Point is not a neighborhood that Mr. Rogers would recognize" (that is, it has been neglected by the city for years and has no proper sewer system, etc).

But he found that the city had not acted maliciously in so depriving them, nor had it singled them out...

The judge accepted the contentions of the city planners, who moved to dismiss the complaint, that a new sewage plant would have to be built to fix the Willets Point waste problem, that the districts' "many small, odd-shaped blocks" and other vagaires hindered development less injurious to its businesses, and that for the city's "investment to become cost-efficient, it should only be made once the area was developed for non-industrial uses."

As to plaintiffs' claim of a "Constitutionally protected property interest," he found that insufficient, comparing it to a hypothetical claim by a rider injured by a subway strike, who "could hardly be said to have a property interest in the continued maintenance of the subway system." He also dismissed their claim of improper notification by the city of hearings, as "plaintiffs here are unable to identify precisely when they should have been provided with a hearing" and "knew far more than three years before the filing of the complaint [his standard for a statute of limitations] that the policy existed" that might lead to their eviction.

It's not known yet whether the Willets Point Industry and Realty Association will appeal.

Update. As a commenter points out, this suit did not explicitly seek to overturn the redevelopment plan. Willets Point United Against Eminent Domain Abuse, a different group, has filed an Article 78 petition "challenging the environmental review that was completed by the City of New York" and seeking to nullify the city council's vote authorizing the plan. This is false information.

At issue was not the development plan, but whether or not City services should have been/should be provided to Willets Point, and whether or not property owners are entitled to damages as a consequence of not receiving services. Those questions are distinct from the development plan.

The author has this law suit, which was brought by WPIRA, confused with the Article 78 Petition, filed by WPU. The latter directly challenges the redevelopment plan.

The facts of the decision are the judge threw out th case. A case where the landowners contended that they are entitled to certain services and that the city puposely dnied the services for 40 years.

This has been a core belief of the business owners and it was cmpletely thrown out of court. Period. This is still the basis of their claim against eminent domain and will likely also be denied.

Whether or not a judge was "sympathetic" is completely irrelevant. In fact, the judge questioned the motives of the plaintiffs in not bringing the suit earlier.

The article 78 petition judgement is expected soon and that will likely be another nail in the WP business owners coffin

That is NOT what the decision said.. The decision said that the Iron triangle is not a neighborhood because it does not have people LIVING THERE.. therefore it is not a neighborhood that MR. Rogers would recognize"

Way to take one line and try to spin it as "sympathy" .. who really cares anyway.. they judge threw out the suit .. a suit that represents the CORE of the WP business owners case. That they were denied services in an attempt to drive them out. The judge said that was a baseless claim.

The judge said the city doesnt have to put sewers and drainage in an area that they plan on changing the street layout.

Stop changing the subject. WP will be redeveloped into a shiny new site and all the polluters that are there now will be gone.

The "willets Point thing" is very close to over. The business owners have nothing to stand on in the courts. The article 78 is a long lon g shot and even the plaintiffs are trying to lower expectations. Any ED hearings -- as we've seen in AY -- will be met with a court system that fully hacks up the government's determination.

Gerrard sold you a bag of goods about the environmental BS and now Bono and the others have to pay the bill.

they should take what they can get and move on. Thiswont go on much longer. A developer will be named (Wang from Lighthouse??) and the phase one area (now almost 3/4 city owned) will start clearing land and getting thngs done.

At that point the clock is ticking on Bono and the others. Should not be too much longer to wrap up the Article 78 and the EDPL should be starting soon.

Best Futures and two others sold out and Vina is all but gone so 126th street can be cleared.
