10 Arrested at Protest Over Detention of Immigration Reform Advocate

There was a protest in Manhattan today over the detention of Jean Montrevil, a Haitian who has had a green card since 1986 but, owing to a drug conviction for which he served time in the 1990s, has been subject to supervision and was detained by U.S. Immigration authorities on December 30.

Organizers claim attendance outside the Varick Street Immigrant Detention Center of about 100 people, 10 of whom were arrested after failing to heed a police order to disperse as they blocked traffic. Among these were Rev. Donna Schaper (above) of Judson Memorial Church, who said, "I am being arrested because it is a moral outrage that our government would do this to such a great man and father."

The protest may raise awareness of Montrevil's case, but it doesn't look as if it will make much difference in the disposition of it, judging from this statement from Michael W. Gilhooly, Northeast Communications Director for U.S. Immigration and Customs Enforcement:

"Jean Murat Montrevil is an aggravated felon with a significant criminal record who has a final order of removal from an immigration judge," says Gilhooly. "Montrevil has exhausted all of his appeals and ICE will enforce the immigration judge's order. One of ICE's primary missions is to removal foreign national criminals from the United States."

Among the protesters who were not arrested was musician Dan Zanes (above), who performed for the crowd. Protesters also called for the reform of U.S. immigration laws.

Montrevil, an immigration rights activist whose cause is supported by Representative Nydia Velazquez and state senator Tom Duane, among others , is at Pennsylvania's York County Prison, where he is said to be on a hunger strike. He has a wife and four children in the U.S.

Jean Montrevil has a job - he runs a small business that employs Americans. His wife and 4 children are all US citizens. Deporting him breaks up an American family!

20 years ago when he was crazy teenager he did the wrong thing and he paid the price - he served his full sentence in jail and came out reformed - the 'correctional institution' actually corrected him! Why shouldn't we celebrate that? and let him stay here like all our immigrant forebears?
Especially religious leaders know that forgiveness, after repentence, is basic to Christianity. Today's rally was a great statement!

Folks should really get the facts before labeling productive members of society deadbeats. Mr. Montrevil is churchgoing upstanding member of his community and an outspoken activist for immigrant rights, which is the real reason he was detained. If he is deported, his family will be destitute. Is that really a good solution? To deport a working man who is supporting his family and therefore make his family dependent on the state?

These bums won't look for a job. Leave it to a scruffy hippie to get arrested so he/she can get another free meal on our dime.

He was arrested on old drug charges. Likely these protesters are his clients and they are going through withdrawals while he slim-fasts in jail. Here's a hint, hippies: hang out at the free-needle exchange and you'll meet more drug dealers.

Big Bear, I don't think those arrested were in jail long enough to get a meal, so I don't think you have to worry about that. Also, I wouldn't call members of the clergy hippies, that's just disrepectful. I know Jean, and he was not supplying anything except inspiration to a struggle for justice for all human beings in this country, citizens and non citizens alike. The due process violations suffered by non citizens puts everyone's constitutional and human rights at risk every day.

Instead of protesting the Government for doing it's job, maybe you should take a look at who is really at fault for your children's prediciment, and that is you and your husband. No one told you to have four children with a non citizen who was ordered deported years ago that you couldn't afford to have. That was your own choice. Your children are the unfortunate victims in your and your husband's stupidity. Stop blaming the Government for doing it's job and enforcing the law and stop looking for a handout.

Lawful Permanent Residents get deported for so much less offenses than the one that this guy committed. They can be deported and lose their Green Cards for crimes as minor as jumping the turnstyle. Ask any Immigration Lawyer and he will tell you the same thing. What make people think that someone who did 11 years in prison for seeling drugs should be allowed to stay when people that jump the turnstyle or shoplift aren't able to stay? The gall on some of you parasites is amazing with you sense of entitlement that the United States owes you something. Immigration is a privledge, not a right. The United States is not required to accept foreigners from other countries. There are countries such as Japan that have no Immigration at all. Try going over there if you don't like it here, the most welcoming nation to Immigrants in the world.

Laws can be overturned and changed, and civil disobedience has a long and glorious history in this country--it was used to end slavery, give us the 8 hour day and 40 hour week, and bring civil rights to all Americans, among other things. Jean's fight shows us how a quite recent law--1996--ended immigration judges discretion to take into consideration all the factors in someone's life before deporting him. We need to restore that right so that people and families like Jean's are not destroyed despite that they are contributing members of American society.

My boyfriend Mike is appealing a final removal order. An LPR since 1962, he also is a victim of IIRIRA, the 1996 amendment to the INA.

How could Mike have known that a $50 80-track tape deck would 23 years later put him on the wrong end of the DOJ and the agency charged with keeping us safe from terrorists? The tape deck caper happened in 1977. Misdemeanor conviction in 1978. Expunged in 1983. Removal made possible by a law passed in 1996 (IIRIRA).

Mike has applied a legal remedy that he's entitled to, but it has been ignored by the DOJ's Board of Immigration Appeals. The BIA can rule against you in an unopposed motion. The DHS chose not to bother arguing against Mike before the BIA; it didn't have to. The BIA is a rubber stamp. Judicial review is severely limited by IIRIRA. It's all stacked against the immigrant. 8 1/2 years of battle is breaking Mike down mentally. He's not having a good life.

The DHS has strong armed the surety company into forfeiting Mike's bond. ICE can pick him up at any time while he awaits a decision from the 9th Circuit. If he wins this round, then it goes back to the BIA for further processing. If he loses, it's deportation with 20 years in jail should he ever return to the U.S.

Is this a life worth living? Frankly, I wonder if he should abandon the idea of being near family and loved ones. He can go to his native country of Canada where he knows no one, be banished for good, start over. So he'll never see his ailing elderly parents and won't be able to attend weddings, graduations, funerals, etc. He won't be around when his grandchildren are born. Maybe it would still be better than the hell he's in now. And frankly, I'm tired of what the U.S. government has done to him. I'm tired of keeping suicide watch. I'm tired of the PTSD. I'm tired of hating the government every waking moment of my life.

I feel for the Montrevil family. It's a terrible thing to have to go through. My family has escaped despots and dictators around the globe to come live in a country that cages its immigrants. Shameful.
