On the R. Kelly Not-Guilty Verdict

When the news came out this past Friday that R. Kelly's jury had found him not guilty on all counts of child pornography, the first person I told about it had this reaction: "What? Really? Awesome! Or, um, I mean, I guess. Maybe not. Fuck. I don't know." I'm paraphrasing here, but I do know that I watched a coworker cycle through about fifteen different reactions in three seconds. The second person I told had the exact same reaction. And if I'm being honest, so did I. For entirely selfish reasons, it's natural enough to feel good when a favorite musician wriggles out of a predicament that would've kept him from making music for a long, long time. Except that I'm pretty sure there's not one person on the face of the earth who honestly believes that some shadowy miscreants digitally altered the famous Kelly sex-tape, putting his face on some random dude's body the way special-effects people put Shawn Wayans's head on a baby in Little Man. It's basically impossible, considering the costs and logistics and the general pointlessness of such an enterprise. And yet that's what Kelly's lawyers claim might've happened. The press even called it the Little Man defense. Reading the daily trial reports, I was totally dumbfounded that Kelly's assuredly very expensive legal team couldn't have come up with anything better than that.

Another defense strategy: Claiming that the guy in the tape wasn't Kelly because Kelly has a distinctive mole on his lower back, and that mole wasn't on the guy in the video. But the prosecutors managed to find a digital-video expert who pointed out the the mole actually was on the guy in the video. Even if they defense lawyers later produced another expert, one who testified that the mole was actually just digital noise, the prosecutors still got in a pretty devastating gotcha moment. I was dead certain Kelly was going to prison after reading about that. But no. He's free today, and I only have the vaguest of ideas how that could've happened.

Those daily reports of the trial probably didn't quite convey the spell that the Kelly legal team must've been working. A couple of years ago, I covered the Irv and Chris Gotti money-laundering trials for this paper. Most of the people paying attention to the case thought those guys were going to prison. This was a federal case, and the federal conviction rate is somewhere in the upper 90s. Before the verdict came out, when I predicted that the Gotti brothers would be getting off, Doug Simmons, then the Voice's managing editor, told me I was crazy. They got off. And the only way I can really explain it is that there's really no way to explain what, exactly, a high-priced lawyer does. They make motions and argue against evidence being admitted and voice objections every few minutes, or at least they did in the Gotti trial, but that doesn't really cover it. They're hams. They entertain. They willfully make themselves look like absolute asses if it'll maybe make the prosecution's case look a little more ridiculous. They express frustration at prosecution antics in the most overblown, exaggerated ways possible. And I'm guessing jurors appreciate that because trials, even highly-publicized and dramatic trials with lots of big hush-the-crowd moments, are really boring. Most of the time, everyone's waiting around for the lawyers on both sides to argue some arcane point or for some other case to wrap up. So when someone goes the extra mile to hold everyone's attention, jurors are probably that much more likely to get people over to their side. Voice web news editor Mike Clancy, who was covering the Gotti trials for A.M. New York back before he worked here, pretty much walked me through the trial stuff that I didn't understand, and even he's at a loss to describe how exactly these lawyers work. You know when you're watching a great lawyer at work, but that doesn't mean you can explain what makes them great.

Of course, Kelly's trial was delayed for about a decade before it finally took place, and it must've been about impossible to find a jury in Chicago who hadn't already formed some opinion about it. And jurors have claimed, since the trial ended, that they believe Kelly actually was in the video but that maybe the girl wasn't. The alleged girl claimed in front of a grand jury that it wasn't her in the video, and she never testified during the actual trial, so that probably helped out the defense's case. But this definitely seems to be one of those cases where money and starpower made all the difference, which is pretty gross.

I'm happy Kelly will be able to make more music in the coming years, but in Kelly's case, it's impossible to separate the artist from the art. Other than maybe Prince, I can't name any prominent artists who have sung about freaky sex with anything like Kelly's specificity and inventiveness and consistency and enthusiasm. He's been singing passionately about freaky sex since I was in middle school. And so maybe it's no surprise that his appetites might extend way beyond what's OK and into some Caligula-level shit. He's spent something like half his career in the shadow of this trial, and most of his best freaky-sex songs came after those charges had gone public. Right in the middle of the trial, he released a hilariously carefree freestyle over Hotstylz' great dozens-playing snap novelty "Lookin Boy." With the very real possibility of years in prison right in front of him, R. Kelly jumps on a song to make fun of girls who look like Shabba Ranks and Flavor Flav and Elmer Fudd and strippers with bullet-wounds. This guy is not normal, and that works out pretty well for those of us who like freaky pop music. But his money and fame just allowed him to escape from what looked like a near-certain prison term for fucking an underaged girl, pissing on her, and taping it. I don't like to get all moralistic in this space, but that is wrong. R. Kelly's a great singer, but he's not that great.

What's really funny (or not) is how everyone on the internet is totally up in arms about how Kellz is into golden showers, but hardly anyone seems all that bothered about the girl allegedly being 13.

Even more remarkable, during the trial he did a remix of Raheem DeVaughn's "Customer"... in that song, of course, fast food's a metaphor for sex, and Kells says right at the end of his verse that "if you're feeling thirsty, I've got some good good lemonade."

The over 90% conviction rate claimed by the feds is little more than an urban legend. While it is true that over 90% of federal cases end in plea agreements, the conviction rate in cases going to trial is barely 50%.

R. Kelly was innocent of the charges brought against him. The jury made the correct decision.

A case like that would have to be decided on the basis of 'reasonable doubt' I would think. If as you say it's extremely unlikely, expensive, and unwieldy for someone to have bothered to do that so-called 'little man' thing; switched the heads, then that doesn't sound like reasonable doubt to me. True it's not utterly impossible that someone did it, but it's damned unlikely and I think he must've been guilty myself.

Good article about the trial and its implications. Hopefully the not-guilty verdict will allow for a freer climate to talk about Kelly's music without every discussion of his work deteriorating into a debate about those allegations, with "defenders" and "haters" choosing sides.

It will be interesting to see what direction the King of R&B's career takes from this point forward. At age 41, I would put him down for about 3-4 years more of his current hip-hop efforts (I'm a Flirt remix, Hairbraider, etc.) and then hopefully about 5-10 years of TP-2.com type music (personally my favorite style of his, and he could potentially reincorporate some of the mid-90's 'R. Kelly' self-titled vibe again as well). Then, as he passes 50, I see him making countless Motown-style/Happy People/U Saved Me albums for as long as he wants.

It's clear Kelly is an incredible musical talent, and I think that like Prince, his art will remain fresh and vibrant for many years to come. (As a bonus, there will probably be many more chapters of Trapped in the Closet for comic relief, too!!)

I personally found his sudden popularity among the hip cognoscenti around the time of Chocolate Factory too perverse to try any of the albums (though I admit "Trapped in the Closet" and "Same Girl" certainly bespeak of talent and cleverness I didn't want to believe in).

But I'm glad a fan isn't pushing logistics aside just because. He may in fact be a great artist, but irony or no irony, Kelly is not a cool person.

I saw the imfamous tape and to tell you the truth I really didn't think that the second guy was R Kelly. Truth be told I stated that as soon as he came on. My reaction was "Wow, did his thing (penis) shrink!" What ever the case maybe I really don't think that people should be so hard on R Kelly. I mean I'm a 28 year old woman and at the age of 14 she was taking better than I could at the age of 25. What is this world coming to? And for the people that was saying that if he went to jail it would be horrible for his career. I can only imagine the number of songs he would write and sell with nothing but time on his hands to write while in jail. Come on, think about it.

I am amazed at how many people actually thought it was OK to watch the tape repeatedly. At that time, I had a 13 year old daughter so the thought of seeing that was utterly repulsive regardless of who the man was. Do I believe that it was Robert in the video? Yes, I do. Do I believe he should have been convicted on those charges? No, because it was consensual and the girl denied it was even her so she was fine with it. It wasn't like she was new to the act. I heard she worked it like most of my 30 something year old friends have yet to learn how to do. And I don't give a damn what age you are, you know if you do not want someone urinating on you.
So, who's really guilty here? How about this child's aunt and parents. I can't understand how or why she had opportunity to hang around this grown man. My child could never have been around him PERIOD. Sounded like her aunt, Sparkle, pimped her out and got mad when Kell didn't pay her!!!!

If reasonable doubt can be left after viewing photographic evidence simply by asking a jury to consider the realm of what is possible, then everybody's going to be getting off. Everybody that's rich & famous at least.

R Kelly got what he deserved, NOT GUILTY!! I know lots of people are thinking he got away with it, cuz they all thought he was guilty. But he did not get away with anything, if anything something was taken from him. For those 6 1/2 years and really for many more years to come, people are going to continue to judge him. But I say FUCK ALL THOSE HATERS. Cuz they only one who can judge us is God and it was God who made sure Robert got what he deserved, NOT GUILTY! Love ya R, a fan for life!!

The jury said the reason they found him not guilty was because they could not identify the girl on the tape. That sounds really dumb when almost all of them admitted they believe that it was him on the tape. Question? does it matter who the girl is on the tape. If they believe that it was him on the tape having sex with a child, you would think that would be enough for a guilty verdict. R.Kelly might make good music, but he is still a very sick individual who needs help. And for all of you so-called R.Kelly fans out there if that was your child on that tape I think all of you would a different outlook on the matter.

Sex with a thirteen-year-old is not "freaky sex." It is rape. Seems like R. Kelly's got a whole lot of money and a whole lot of perverse tendencies. I definitely would not want to sneak a peak at that dude's computer hard drive. We all know that R. Kelly has some kind of kiddie-porn lair inside his mansion with an encrypted server storing 50 terrabytes of the most loathsome filth imaginable. You probably need a retinal scan to gain access to the inner sanctum. He probably didn't show this part of the house on Cribs for obvious reasons.

I dont know if r kelly was actually guilty or not but it does look very suspicious. Money buys so many things in this world and it may have bought his freedom. However I am always amazed when I read comments about how good his music is. He is virtually talentless! The irresponsible image and message he portrays is pathetic and typical of someone who has to rely on explicit and volgar material instead of talent to make money! In fact his last album double up was the most grotesque example of all. It had everything that an album should not have. From vile lyrics about weed induced threesomes, flirting with and stealing peoples wives,pimping whores, and screaming profanity down the phone! To artwork that makes him look like a 41 year old pratt who is dressed like a 16 year old! In short he is an enbarrasement to soul/rnb music and should do us all a favour and stop punishing our ears with his awful music.

Look, I like Kelly's music. But the prosecution had a weak case, an alleged victim that claims she isn't the one on the tape, and a star witness who was totally shady. The jury never got to hear about Aliyah or the other women that he settled with out of court. I really don't think that Kells got off because of his money or his celebrity, he got off because the state couldn't meet the burden of proof. Do I think he did it, yeah, probably, but with nothing to go on but a shitty 2nd generation dub of the tape, can you really blame them for finding reasonable doubt?

Bottom line. They had no case. If the girl told the grand jury it wasn't her, then doesn't testify in the actual trial, and THEN her money-hungry parents testify in court it's not her - it's a wrap! Child molester goes free. I like the guys music but, he ain't right. Don't forget he married Aaliyah when she was 15, without the knowledge of her parents, who immediately had the marriage annulled when they got their daughter back. He also was caught with STACKS of child pornography in Florida and that case was thrown out on a technicality.

R. Kelly is lucky to have beat the system. He is guilty and he knows it. He got away with molesting young girls and he will go on with his life as if nothing ever happened. He needs to be very careful because he will be under a microscopic eye not only by the media but by GOD also. HE kept you this far but the next time you may not be so lucky because when GOD removes HIS hand you will be done and the justice system will not be able to help you because GOD'S VERDICT will OVERRULE!!!!

When someone could tape themselves doing disgusting things to a minor and get acquitted, then it doesn’t say something about the perpetrator but the legal system. Look at history…

Rodney King gets videotaped getting beaten and the cops are acquitted,

R.Kelly was guilty, I live in Chicago, we all saw the tape. Also, he's been doing that to underage girls since I was in highschool. That's neither here nor there...he got off because the girl didn't testify. The jurors even said it. If you can get the girl to prove her identity on the tape, you can't send him to jail. Bottom line.

I fail to understand why you are all so incensed and pissed off. No victim no case! Whether it was him or not was never the issue. The so-called victim said it was not her over and over again, getting to a point where said she was being harassed. Even if it was her, she made her choice. The crime here is that the Prosecution wasted tax payers money on a case they were never going to win. Someone needs to get fired!

I personally, am very happy that R. Kelly is free. I would have been quite upset had he been unfairly place and confined behind bars. He is so very talented.

I find this all very interesting but, expected in a way. off topic alittle. but if anyone remembers not so long ago those Duke university students were accussed of raping that black dancer that came to their party. The majority of articles wrote, news interviews given or internet blogs, and all around media coverage didn't condemn them. But rather gave them every benefit of the doubt... Those that are blogging as well as those that write alot of these articles are very bias. The facts are, R. Kelly has been found not guilty by a jury of his peers and that is the ONLY thing that matters.

upon this site accidently but I also saw that video and I was disgusted. I believe
that was R.Kelly with that child but with
all his available funds and the overly long time before an actual trial I knew he was not going to jail and that makes me sick. Just the thought of another celebrity pedophile out stalking our children scares me. Not that there aren't
many more of their kind roaming our cities who if caught will go to jail where belong. But the wealthy R.Kelly's
and Michael Jackson's of the world will probably never be prosecuted as long as they have that Dream Team money for their legal services. And whether the girl in the video was/was not the child
witness, it's obvious the girl was way too young to be with a grown man. I saw the tape and trashed all my R kelley cds afterwards. I was 15 at the time. It amazes me how black americans, particularly adults, can blindly follow someone who is clearly guilty. I don't need a misguided jury to guide my morality. The facts were clear and i'm intelligent enough to see them. Perhaps some think that his music should be separate fom his personal life, but I would no more buy his work than I would donate money to a child molester. HE MARRIED A 15 YEAR OLD.
